【摘要】：為了確保汽車行業(yè)在智能互聯(lián)領(lǐng)域的戰(zhàn)略領(lǐng)先地位,德國于2017年5月12日正式通過了首部針對自動駕駛汽車的法案,對《道路交通法》進(jìn)行了修訂。該法案明確允許"按規(guī)定使用"自動駕駛功能,明確了駕駛員使用該功能的權(quán)利義務(wù)以及駕駛數(shù)據(jù)的采集、存儲、使用及刪除規(guī)則,從而建立了較為完整的權(quán)責(zé)制度,在一定程度上為智能汽車在德國的發(fā)展清除了法律上的障礙。鑒于智能汽車技術(shù)尚未定型和產(chǎn)業(yè)化,法案的某些概念和規(guī)定較為彈性和模糊,具體內(nèi)涵有待將來通過技術(shù)標(biāo)準(zhǔn)、國際條約乃至法院裁判加以明確。有關(guān)事故賠償責(zé)任、保險(xiǎn)制度、數(shù)據(jù)處理和信息安全方面的規(guī)則也仍有進(jìn)步的空間。
[Abstract]:In order to ensure the automotive industry's strategic leadership in the field of intelligent interconnection, Germany formally passed the first law on self-driving cars in May 12th 2017. The Law on Road Traffic has been amended. The Act explicitly allows for the "use of" autopilot function as well as the rights and obligations of drivers to use this function, as well as the collection and storage of driving data. By using and deleting the rules, a relatively complete system of power and responsibility has been established, which to some extent clears the legal barriers to the development of intelligent vehicles in Germany. In view of the fact that the technology of intelligent vehicles has not yet been finalized and industrialized. Some of the concepts and provisions of the bill are more flexible and vague, the specific content of the future need to be passed through technical standards, international treaties and even court decisions to clarify the relevant accident liability, insurance system. Rules on data processing and information security also have room for progress.
