【摘要】：行為法律經(jīng)濟學(xué)是融合法學(xué)、經(jīng)濟學(xué)與心理學(xué)的一種綜合分析方法,被認為是法律經(jīng)濟學(xué)的前沿領(lǐng)域。對這一領(lǐng)域,法律經(jīng)濟學(xué)研究者皆知美之為美,并在十年間進行了諸多介紹,但卻極少有學(xué)者嘗試運用這一最新方法對部門法具體問題展開分析,僅有的分析也表現(xiàn)出了諸如未能銜接法律經(jīng)濟學(xué)經(jīng)典理論、分析參數(shù)有限、分析工具的適用零散且隨意以及行為分析缺乏準確性等問題。究竟如何使用行為法律經(jīng)濟學(xué)分析方法研究部門法問題、進而促進法律經(jīng)濟學(xué)的“轉(zhuǎn)型升級”?學(xué)界對此仍莫衷一是,亟待整合、提煉出相對完整的分析范式。
[Abstract]:Behavioral law economics is a comprehensive analysis method of combining law, economics and psychology. It is considered to be the frontier field of law and economics. To this field, the researchers of law and economics all know the beauty of beauty. During the past ten years, many introductions have been made, but few scholars have tried to use this latest method to analyze the specific problems of the department law. The only analysis has shown such as the failure to link up the classical theory of law and economics. The analysis parameter is limited, the application of the analysis tool is scattered and random, and the behavior analysis lacks the accuracy and so on. How to use the behavior law economics analysis method to study the department law question. And then promote the "transformation and upgrading" of law and economics? The academic circles still have different views on this and need to be integrated to refine a relatively complete analytical paradigm.
