【摘要】：洛克的法律思想是他所處的時(shí)代的產(chǎn)物。他從事政治活動(dòng)和理論活動(dòng)的主要年代是英國(guó)資產(chǎn)階級(jí)同封建貴族進(jìn)行妥協(xié)的時(shí)期。作為新興資產(chǎn)階級(jí)的代言人,洛克的政治學(xué)著作《政府論》上下兩篇是反映他的法律思想的代表作。尤其是《政府論》下篇,包含了他許多重要的法律思想,如在自然狀態(tài)下,自然法起支配作用;法律的主要目的是保護(hù)私有財(cái)產(chǎn);法律制定以后,就必須執(zhí)行;立法權(quán)是最高權(quán)力;人民是最高的裁判者。從洛克的自然法理論、法治與分權(quán)、法律與自由等方面對(duì)其法律思想進(jìn)行詮釋和論證,闡述對(duì)我國(guó)當(dāng)代法制建設(shè)的參考價(jià)值。
[Abstract]:Locke's legal thought was the product of his time. His main age of political and theoretical activities was when the British bourgeoisie compromised with the feudal aristocrats and acted as the spokesman of the emerging bourgeoisie. Locke's political work, the Theory of Government, is a masterpiece of his legal thought, especially the second one, which contains many of his important legal thoughts, such as in the state of nature. Natural law plays a dominant role; The main purpose of the law is to protect private property; After the enactment of the law, it must be implemented; Legislative power is the supreme power; The people are the highest judge. This paper interprets and demonstrates Locke's theory of natural law, rule of law and separation of powers, law and freedom, and expounds the reference value for the construction of contemporary legal system in China.
