【摘要】:愛(ài)爾蘭作為一個(gè)傳統(tǒng)意義上的天主教國(guó)家,天主教自愛(ài)爾蘭脫離英國(guó)殖民統(tǒng)治后就占據(jù)了非凡的政治地位。天主教的教義被寫(xiě)入法律和憲法,成為愛(ài)爾蘭人生活的行為準(zhǔn)則。然而在世紀(jì)之交,隨著愛(ài)爾蘭經(jīng)濟(jì)發(fā)展帶來(lái)的世俗化,天主教政治影響力大不如從前,新的政教關(guān)系自此形成。要考察這種變化的政教關(guān)系,一個(gè)很好的切入點(diǎn)就是二十世紀(jì)末通過(guò)的離婚法案;橐龊图彝(wèn)題一直是教會(huì)的傳統(tǒng)管轄范圍,天主教有關(guān)婚姻和家庭的教義也被寫(xiě)在憲法里,婚姻自此被法律保護(hù),離婚遭到禁止。而20世紀(jì)80年代政府依據(jù)愛(ài)爾蘭國(guó)情制定出離婚法的提案,打破了教會(huì)在這一領(lǐng)域的壟斷。離婚法經(jīng)過(guò)兩次全民公決,于1997年正式生效,其中政府在其中起到了重要的推動(dòng)作用,也預(yù)示了天主教會(huì)在社會(huì)事務(wù)中影響力的退化和新的政教關(guān)系的形成。然而學(xué)術(shù)界對(duì)于這一階段的愛(ài)爾蘭政教關(guān)系考察不多。本文旨在通過(guò)考察愛(ài)爾蘭政府在1980年到1996年間對(duì)于離婚法的推動(dòng)作用,并通過(guò)對(duì)比政府提出離婚法的議案前后教會(huì)在社會(huì)事務(wù)中的影響力,探究離婚法案從草擬到最后的通過(guò)反映出的愛(ài)爾蘭政教關(guān)系。研究發(fā)現(xiàn),整個(gè)過(guò)程表明了教會(huì)對(duì)于社會(huì)事務(wù)的影響力進(jìn)一步削弱,而政府的控制力進(jìn)一步加強(qiáng)。本文主要采取研究歷時(shí)現(xiàn)象常用的歷史研究方法,并試圖融合文本分析與世俗化理論的運(yùn)用。采用的主要史料包括關(guān)于離婚的議會(huì)辯論,1980年到1997年之間頒布的有關(guān)婚姻的法律文獻(xiàn),愛(ài)爾蘭憲法,教會(huì)文獻(xiàn),同時(shí)亦參考了重要的二手史學(xué)文獻(xiàn)。
