【摘要】：目的探討職業(yè)病診斷標(biāo)準(zhǔn)溯及力問(wèn)題,完善職業(yè)病診斷標(biāo)準(zhǔn)的正確適用和法律規(guī)范的理論依據(jù)。方法依據(jù)法律溯及力的相關(guān)理論與原則,對(duì)職業(yè)病診斷標(biāo)準(zhǔn)的不同溯及力與利弊進(jìn)行分析,探討在我國(guó)現(xiàn)行職業(yè)病診斷與鑒定制度下新舊職業(yè)病診斷標(biāo)準(zhǔn)的適用方法。結(jié)果職業(yè)病診斷標(biāo)準(zhǔn)更新頻繁,但新舊職業(yè)病診斷標(biāo)準(zhǔn)的適用缺乏明確規(guī)范規(guī)定,社會(huì)對(duì)新舊職業(yè)病診斷標(biāo)準(zhǔn)適用的理解存在誤區(qū),對(duì)職業(yè)病診斷與鑒定工作的影響較大。職業(yè)病診斷標(biāo)準(zhǔn)屬于法律規(guī)范,其適用的實(shí)質(zhì)是法的溯及力問(wèn)題。職業(yè)病診斷標(biāo)準(zhǔn)若不溯及既往可能不利于合理保障勞動(dòng)者健康權(quán)益。職業(yè)病診斷標(biāo)準(zhǔn)溯及既往體現(xiàn)了社會(huì)法的價(jià)值取向,但在其適用的同時(shí)必須遵循法律法規(guī)和相關(guān)規(guī)范性文件的規(guī)定。結(jié)論職業(yè)病診斷適用診斷時(shí)生效的職業(yè)病診斷標(biāo)準(zhǔn),職業(yè)病鑒定沿用診斷時(shí)適用的標(biāo)準(zhǔn)。
[Abstract]:Objective to discuss the retroactive effect of occupational disease diagnostic standard, to perfect the correct application of occupational disease diagnosis standard and the theoretical basis of legal norm. Methods according to the relevant theory and principle of legal retroactivity, This paper analyzes the different retroactivity, advantages and disadvantages of occupational disease diagnostic criteria, and discusses the applicable methods of new and old occupational disease diagnostic standards under the current occupational disease diagnosis and appraisal system in China. However, the application of the new and old diagnostic standards for occupational diseases lacks clear and normative provisions, and there are some misunderstandings in the understanding of the application of the new and old diagnostic standards of occupational diseases, which have a great impact on the diagnosis and identification of occupational diseases, and the diagnostic standards of occupational diseases belong to the legal norms. The essence of its application is the retroactive effect of law. If the diagnostic criteria for occupational diseases are not retroactive, it may not be conducive to the reasonable protection of workers' health rights and interests. The retroactivity of occupational disease diagnosis standards reflects the value orientation of social law. Conclusion the occupational disease diagnosis is effective in the diagnosis of occupational disease, and the standard used in the diagnosis of occupational disease should be followed.
