【摘要】：為了促進(jìn)計(jì)劃疫苗損害救濟(jì)的實(shí)現(xiàn),保障公民健康權(quán)益,基于法的規(guī)范分析,計(jì)劃疫苗預(yù)防接種應(yīng)是一種具體行政行為,體現(xiàn)了強(qiáng)制醫(yī)療法律關(guān)系。接種單位在履行預(yù)防接種職責(zé)時(shí),如果造成了受種者損害,其損害賠償應(yīng)屬于國(guó)家賠償?shù)姆懂�。�?jì)劃疫苗預(yù)防接種行政行為損害賠償責(zé)任構(gòu)成要件具體包括:預(yù)防接種行為中的侵權(quán)主體屬于國(guó)家賠償責(zé)任的主體、有違法的預(yù)防接種行為、有預(yù)防接種法律損害事實(shí)、預(yù)防接種違法行為和損害后果之間存在因果關(guān)系。
[Abstract]:In order to promote the realization of planned vaccine damage relief and protect the health rights and interests of citizens, based on the normative analysis of law, planned vaccine vaccination should be a specific administrative act, which embodies the legal relationship of compulsory medical treatment. When inoculation unit performs its duty of inoculation, if it causes damage to the seed, its damages should belong to the category of state compensation. The constitutive elements of the liability for compensation for damage caused by administrative acts of planned vaccination include: the tort subject in the act of preventive vaccination belongs to the main body of the national liability for compensation, there are illegal acts of preventive inoculation, and the fact of legal damage of preventive vaccination, There is a causal relationship between the illegal act of inoculation and the consequence of damage.
