【摘要】：根據(jù)2005年國務(wù)院《疫苗流通和預(yù)防接種管理?xiàng)l例》的要求,全國(未包括香港、澳門特別行政區(qū)和臺(tái)灣地區(qū),下同)所有的省、自治區(qū)、直轄市和新疆生產(chǎn)建設(shè)兵團(tuán)已公開發(fā)布相應(yīng)的補(bǔ)償辦法,對(duì)預(yù)防接種異常反應(yīng)給予一次性補(bǔ)償。其中,補(bǔ)償測(cè)算方法和補(bǔ)償額度是政府、疫苗生產(chǎn)企業(yè)、疫苗受種方等各方關(guān)注的核心問題。本研究比較分析了各省份的預(yù)防接種異常反應(yīng)補(bǔ)償測(cè)算方法,并計(jì)算了各省份各類損傷的補(bǔ)償額度。2014年1歲以內(nèi)嬰兒死亡補(bǔ)償金、殘疾生活補(bǔ)助費(fèi)、其他損傷費(fèi)用補(bǔ)償?shù)淖罡哳~度中位數(shù)分別為28.2萬元、5.1萬元~46.2萬元和2.3萬元。研究發(fā)現(xiàn)省際間異常反應(yīng)補(bǔ)償額度差異過大、同類損傷補(bǔ)償費(fèi)用種類不一、補(bǔ)償費(fèi)用測(cè)算彈性過大、補(bǔ)償申請(qǐng)與審核程序復(fù)雜等問題。建議各省份逐步向總體費(fèi)用補(bǔ)償?shù)姆较虬l(fā)展,逐步平衡或統(tǒng)一不同省份同一類型損傷的補(bǔ)償費(fèi)用類別,進(jìn)一步明晰測(cè)算指標(biāo)和測(cè)算方法,并簡化補(bǔ)償申請(qǐng)手續(xù)。對(duì)不足以證實(shí)或排除的預(yù)防接種異常反應(yīng),可采取"疑點(diǎn)利益歸屬于受害人"的原則給予一定補(bǔ)償。建議國家層面可考慮計(jì)算補(bǔ)償資金需求,針對(duì)多方來源進(jìn)行補(bǔ)償專項(xiàng)籌資,以對(duì)各省份提供支持,推動(dòng)補(bǔ)償制度的發(fā)展完善和預(yù)防接種異常反應(yīng)風(fēng)險(xiǎn)管理。
[Abstract]:According to the regulations of the State Council on the Administration of Vaccine Circulation and Preventive vaccination of 2005, all provinces and autonomous regions throughout the country (excluding Hong Kong, Macao Special Administrative region and Taiwan region, the same area below), The municipalities directly under the Central Government and the Xinjiang production and Construction Corps have publicly issued corresponding compensation measures, which will provide one-time compensation for abnormal vaccination reactions. This study compared and analyzed the compensation methods for the abnormal response of vaccination in different provinces, and calculated the compensation amount of various kinds of injury in each province. 2014, the compensation for infant death under 1 year old. The median of compensation for disability living expenses and other injury costs were 282,000 yuan, 51,000 yuan to 462,000 yuan and 23,000 yuan respectively. It is suggested that each province should gradually develop toward the direction of overall cost compensation, and gradually balance or unify the categories of compensation costs for the same type of injury in different provinces. To further clarify the measurement indicators and methods, and to simplify the procedures for applying for compensation. Abnormal reactions to vaccinations that are not sufficiently verified or excluded, It is suggested that at the national level, consideration could be given to calculating the need for compensatory funds and providing special funding for compensation from multiple sources in order to provide support to the provinces. Promote the development of compensation system and the risk management of vaccination abnormal reaction.
