【摘要】：隨著經(jīng)濟(jì)的發(fā)展和全球化,商務(wù)合同不僅在促進(jìn)跨國經(jīng)濟(jì)交易和規(guī)范市場秩序方面起著非常重要的作用,而且也成為中外當(dāng)事人開展業(yè)務(wù)和維護(hù)權(quán)益的一種重要法律依據(jù)。由于合同對各方權(quán)利義務(wù)的規(guī)定不夠明確,或因合同措辭不當(dāng)、詞義含混不清、文義松散寬泛等原因,使合同一方有意或無意地利用合同漏洞以逃避責(zé)任和義務(wù),結(jié)果導(dǎo)致合同糾紛,甚至商業(yè)敲詐。因此,商務(wù)合同翻譯的好壞在國際貿(mào)易活動中發(fā)揮著越來越重要的作用。如何做好商務(wù)合同翻譯,就越顯得極為重要。 目前,國內(nèi)對商務(wù)合同翻譯的研究主要是從文體學(xué)、語域?qū)W或功能語法學(xué)的角度進(jìn)行分析,仍然存在大量的不準(zhǔn)確、機械的翻譯現(xiàn)象,所以還需要理論指導(dǎo)。在當(dāng)代西方翻譯理論中,德國功能翻譯理論為指導(dǎo)翻譯實踐提供了一個全新的視角。該理論產(chǎn)生于20世紀(jì)70年代,已發(fā)展成為一個相當(dāng)成熟的理論體系,以奈達(dá)和紐馬克為代表的功能對等論,以漢斯·弗米爾為代表的功能學(xué)派提出的目的論、連貫性法則,“功能加忠誠”原則,在翻譯研究中影響深遠(yuǎn)。然而,國內(nèi)學(xué)者對功能翻譯理論的研究,主要集中在文學(xué)翻譯領(lǐng)域如詩歌翻譯等,對合同翻譯的研究較少。用功能翻譯理論研究商務(wù)合同翻譯,是從一個新的視角對商務(wù)合同翻譯進(jìn)行研究。 如何用功能翻譯理論指導(dǎo)商務(wù)合同翻譯?首先,本論文對商務(wù)合同翻譯研究現(xiàn)狀進(jìn)行了文獻(xiàn)綜述。其次,對功能翻譯理論進(jìn)行了介紹,引入了像“文本分析理論”、“翻譯目的論”、“翻譯綱要”、“功能和忠誠原則”等概念。第三,筆者從宏觀層面如商務(wù)合同文本類型、文本目的、原文本分析等方面對商務(wù)合同進(jìn)行了分析,并輔之以實例加以論證。同時,也從微觀層面如詞匯、句子及篇章等方面對商務(wù)合同語言特點進(jìn)行了分析和總結(jié),從而論證了功能翻譯理論對商務(wù)合同翻譯的適用性。此外,筆者還指出了商務(wù)合同翻譯中存在的一些問題如金額翻譯、專業(yè)詞匯翻譯等,并輔之以翻譯實踐實例進(jìn)行分析。最后,筆者對全文進(jìn)行了總結(jié),并提出了不足之處以及進(jìn)一步研究的建議。 通過進(jìn)行該論文的寫作,筆者對商務(wù)合同的語言特點以及功能翻譯理論的使用更為嫻熟,并在翻譯實踐中盡量避免一些機械、不準(zhǔn)確的翻譯,同時為那些從事商務(wù)合同翻譯的譯者們能夠提供借鑒,使其擔(dān)負(fù)起譯者的責(zé)任,把合同翻譯工作做得更好。
