【摘要】：警察作為維護國家安全和維護社會治安秩序的武裝力量，擔(dān)負著打擊犯罪懲治邪惡的責(zé)任，刑事犯罪作為嚴(yán)重危害社會治安秩序的違法行為，更是嚴(yán)厲打擊的對象。偵查訊問作為刑事訴訟的關(guān)鍵環(huán)節(jié)，起著至關(guān)重要的作用。同時，偵查訊問語言更引起了語言學(xué)界的廣泛關(guān)注，很多語言學(xué)家運用社會語言學(xué)、語用學(xué)的理論來解釋和分析，試圖找出其中的技巧和方法。 偵查訊問的目的是為了獲取犯罪嫌疑人的真實供述和辯解，查明案件的事實真相，，迫使犯罪嫌疑人如實交代自己的犯罪事實，如何巧妙的運用語言，是所有專業(yè)人士關(guān)注的重點。本文主要運用語用學(xué)的相關(guān)理論來進行分析論述，主要是從偵查訊問的語境、會話原則以及語言的模糊性來進行重點的闡釋，希望能探尋出偵查訊問語言自身的特點。 本文共分為五部分。 第一部分：主要介紹本文的選題背景、相關(guān)研究綜述、研究意義、研究方法和預(yù)料來源。 第二部分：本文主要是從語境角度來靜態(tài)解讀偵查訊問語言，主要針對偵查訊問語境特點，語境對偵查語言的限定以及特殊語境預(yù)設(shè)理論對偵查訊問的影響來進行論述。 第三部分：這部分主要應(yīng)用語用學(xué)的會話原則來具體分析偵查訊問語言。首先介紹了語用學(xué)中的會話含義和合作原則理論，然后分別從合作原則的數(shù)量原則、質(zhì)量原則、相關(guān)原則三方面具體闡述偵查訊問語言的違背及會話的結(jié)構(gòu)——話輪轉(zhuǎn)換，特別是在偵查訊問中話輪是如何索要、保持、放棄的語用策略。 第四部分：這部分主要介紹偵查訊問的語用模糊特點，通過語用模糊的相關(guān)理論知識，分別從偵查人員和犯罪嫌疑人角度來進行具體分析。 第五部分：是本論文的結(jié)語。該部分主要是對該論文進行全面的總結(jié)和概況。希望通過本論文能夠給未來研究人員在該領(lǐng)域加以借鑒。
[Abstract]:As an armed force to maintain national security and maintain public order, the police bear the responsibility of cracking down on crime and punishing evil. As an illegal act that seriously endangers the order of public order, criminal crime is the object of severe attack. As a key link of criminal procedure, investigation and interrogation plays a vital role. At the same time, the language of investigation and interrogation has attracted more and more attention from linguists. Many linguists use sociolinguistics and pragmatic theories to explain and analyze, and try to find out the techniques and methods. The purpose of investigation and interrogation is to obtain the true confession and justification of the criminal suspect, to find out the truth of the case, to force the suspect to give a truthful account of his own criminal facts, and how to use the language skillfully. Is the focus of all professionals. This paper mainly uses the relevant theories of pragmatics to analyze and discuss, mainly from the context of investigative interrogation, the principle of conversation and the vagueness of the language, in order to explore the characteristics of the investigative interrogation language itself. This paper is divided into five parts. The first part mainly introduces the background, research significance, research methods and expected sources of this paper. The second part: this article is mainly from the perspective of context to static interpretation of investigative interrogation language, mainly focusing on the characteristics of investigative interrogation context, the context of the limits of the investigation language and the influence of the special context presupposition theory on the investigation of interrogation. Part three: this part mainly applies the conversational principle of pragmatics to analyze the investigative interrogation language. This paper first introduces the conversational implicature and the cooperative principle theory in pragmatics, and then expounds the violation of the investigative interrogation language and the structure-turn conversion of the conversation from three aspects: the quantitative principle, the quality principle and the relevant principle of the cooperative principle. Especially, the pragmatic strategy of how to ask, keep and give up in the investigation and interrogation. Part IV: this part mainly introduces the characteristics of pragmatic vagueness of investigative interrogation, through the relevant theoretical knowledge of pragmatic ambiguity, respectively from the perspective of investigators and criminal suspects to carry out specific analysis. The fifth part is the conclusion of this paper. This part is a comprehensive summary and overview of the paper. It is hoped that this paper can be used for reference by future researchers in this field.
