【摘要】：本文從學科理論的層面,構建了中國古代"應用律學"與"理論律學"的基本概念,并從中國古代律學史上客觀存在的"應用律學"與"理論律學"的歷史勾勒入手,以對當代關論域理論研究成果的分析為參照,探尋我國律學研究中"應用律學"與"理論律學"分野的歷史走向,旨在"厘清分野,追尋沿革,探求規(guī)律,凝練理論"。
[Abstract]:This paper constructs the basic concepts of "applied law" and "theoretical law" in ancient China from the aspect of discipline theory, and begins with the historical outline of "applied law" and "theoretical law" that exist objectively in the history of ancient Chinese law. Based on the analysis of the research results of the contemporary Guan theory, this paper explores the historical trend of the division between the applied law and the theoretical law in the study of law in China, aiming at "clarifying the distinction, pursuing the evolution, seeking for the law, and condensing the theory".
