庭審會話中特指問句的話語結構及信息功能

“問答”是法庭審判的核心組成部分,也是最富有動態(tài)意義和研究意義的部分。在中國刑事審判中,“問答”雖為不可分割的整體,但普遍遵循“問在前,答在后”的原則,從而使問話具有主導性,控制庭審主題,決定庭審進程。簡言之,就庭審特指問句而言,問話的結構和方式比問話內容更加重要。另外,漢語是一種聲調語言,人們交流時語調的各個部分都會對話語信息的傳遞產生影響。因此,法庭問話要想實現(xiàn)問話目的,除了選擇恰當的問話結構,還必須注重語調的參與。語調的信息功能在“有聲性”庭審會話研究中顯得尤為重要;趯鴥19場刑事案件轉寫語料的分析,本文采用定量和定性的研究方法,從主位-述位和焦點分布的角度,對語料中296個特指問句的話語結構進行歸納,并借助Praat語音分析軟件,分析在語調各部分的共同作用下,庭審特指問句的不同話語結構所蘊含的主要信息功能。根據研究結果,本文共歸納出庭審特指問句的3種主要話語結構,即(1)主位+述位,疑問焦點位于述位;(2)主位空缺,疑問焦點位于述位;(3)主位與疑問焦點重合,置于句首。上述三種結構中,主位的信息性質并非固定于已知信息,在前兩種結構中,主位代表已知信息,而在第三種結構中,主...
