規(guī)訓(xùn)權(quán)力通過層級(jí)監(jiān)視等手段來約束并馴順人的行為和思想,而空間是權(quán)力運(yùn)作的重要載體。作為司法審判的實(shí)踐場(chǎng)域,法庭是一種規(guī)訓(xùn)性機(jī)構(gòu),權(quán)力關(guān)系（包括規(guī)訓(xùn)權(quán)力）也體現(xiàn)在其空間結(jié)構(gòu)話語(yǔ)中。當(dāng)前的法庭話語(yǔ)研究揭示了以法官為中心的權(quán)力不平等在庭審言語(yǔ)交際諸多層面的體現(xiàn),而對(duì)于庭審語(yǔ)境中法官權(quán)力的制約因素尚缺乏深入的考察。本文擬從法庭的空間話語(yǔ)角度探討中國(guó)古代法庭中規(guī)訓(xùn)權(quán)力的空間結(jié)構(gòu)配置及其對(duì)法官話語(yǔ)權(quán)力的制約。結(jié)合�？碌摹皺�(quán)力空間”學(xué)說,本文以系統(tǒng)功能符號(hào)學(xué)理論框架為分析工具,對(duì)河南內(nèi)鄉(xiāng)縣衙法庭中空間化的權(quán)力進(jìn)行深入的多模態(tài)話語(yǔ)分析。通過對(duì)法庭空間文本的元功能解讀,本文揭示了古代法庭中多模態(tài)符號(hào)體現(xiàn)的道德教化:視覺圖像（如屏風(fēng)彩繪）和文字文本（如楹聯(lián)文字）兩種模態(tài)相互闡釋,凸顯了中國(guó)傳統(tǒng)司法價(jià)值追求,在潛移默化中規(guī)訓(xùn)著法官的思想意識(shí)形態(tài)與審判行為�？臻g構(gòu)成上,古代法庭可被視為�？率降娜俺ㄊ奖O(jiān)獄:相互延伸的空間文本在功能上擔(dān)當(dāng)了權(quán)力的眼睛,時(shí)刻監(jiān)視、規(guī)訓(xùn)著法官的司法行為,并促使法官在這種凝視性目光中加強(qiáng)自我約束。此外,本文對(duì)一則模擬古代法庭審判的視頻文本進(jìn)行話語(yǔ)分析,一定程度上佐證了此規(guī)訓(xùn)權(quán)力的確能...
