浙江省非法行醫(yī)現(xiàn)狀調(diào)查及長(zhǎng)效治理策略研究

【摘要】： 本文全面論述了近年來浙江省非法行醫(yī)的現(xiàn)狀,逐一分析形成原因,并嘗試從增加醫(yī)療供給和建立長(zhǎng)效監(jiān)管機(jī)制方面提出相應(yīng)策略。 材料與方法:本文根據(jù)全國(guó)打擊非法行醫(yī)領(lǐng)導(dǎo)小組辦公室設(shè)計(jì)的統(tǒng)計(jì)報(bào)格式搜集非法行醫(yī)的主要數(shù)據(jù)。各市衛(wèi)生局協(xié)助收集上報(bào)轄區(qū)內(nèi)所有的報(bào)表,并對(duì)報(bào)表的內(nèi)容進(jìn)行復(fù)核。調(diào)查對(duì)象覆蓋浙江省各級(jí)各類有證醫(yī)療衛(wèi)生機(jī)構(gòu)及無證診所。數(shù)據(jù)包括全省各職能部門在打擊非法行醫(yī)專項(xiàng)行動(dòng)中出動(dòng)的人員、車輛數(shù);全省無證行醫(yī)的查處情況;醫(yī)療機(jī)構(gòu)、計(jì)生機(jī)構(gòu)監(jiān)督檢查情況等。統(tǒng)計(jì)數(shù)據(jù)自2005年5月1日至2007年12月31日。 調(diào)查結(jié)果:1.無證行醫(yī)的場(chǎng)所多存在于外來流動(dòng)人口集中的城鄉(xiāng)結(jié)合部以及部分農(nóng)村地區(qū);2.無證行醫(yī)的內(nèi)容以內(nèi)科和牙科居多;3.查處的無證行醫(yī)案件,移送困難;4.查處的無證行醫(yī)案件中,能追究刑事責(zé)任的少之又少;5.在歷時(shí)2年的打擊非法行醫(yī)專項(xiàng)行動(dòng)中,主要還是靠衛(wèi)生部門開展工作,部門配合不強(qiáng);6.有證醫(yī)療機(jī)構(gòu)最多的違法行為依次為使用非衛(wèi)技人員、超范圍開展診療活動(dòng)、醫(yī)療機(jī)構(gòu)違法發(fā)布醫(yī)療廣告、出租承包科室。 結(jié)論及建議:治理非法行醫(yī)需要標(biāo)本兼治,綜合治理。一方面要完善法律法規(guī),建立預(yù)防和打擊非法行醫(yī)的政策體系,進(jìn)一步提高執(zhí)法水平,探索長(zhǎng)效監(jiān)管機(jī)制。另一方面根本出路在于政府增加必要的投入,切實(shí)負(fù)起滿足群眾基本醫(yī)療需求的責(zé)任,特別是建立面向外來務(wù)工人員、弱勢(shì)群體的醫(yī)療保障體系。采取疏堵結(jié)合,打防并舉,力求從源頭和根本上斷絕非法行醫(yī)的土壤,合理規(guī)范醫(yī)療秩序,才能達(dá)到長(zhǎng)效治理的效果。
[Abstract]:This paper comprehensively discusses the current situation of illegal medical practice in Zhejiang Province in recent years, analyzes the causes one by one, and tries to put forward corresponding strategies from the aspects of increasing medical supply and establishing long-term supervision mechanism. Materials and methods: the main data of illegal medical practice were collected according to the statistical report format designed by the Office of the National leading Group for Combating illegal practice of Medicine. The municipal health bureau assists in collecting all the reports in the reporting area and reviewing the contents of the reports. The subjects covered all kinds of licensed medical and health institutions and unlicensed clinics in Zhejiang Province. The data include the number of personnel and vehicles dispatched by all functional departments in the special action against illegal practice of medicine; the investigation and punishment of unlicensed medical practice in the province; the supervision and inspection of medical institutions and family planning institutions. The statistics cover the period from 1 May 2005 to 31 December 2007. The result of the investigation was 1: 1. Unlicensed practice of medicine mostly exists in the urban and rural areas where the migrant population is concentrated and in some rural areas. The content of unlicensed medical practice is mostly in internal medicine and dentistry. Investigation and treatment of undocumented medical cases, transfer difficulties. In the cases of undocumented medical practice investigated and dealt with, very few of them can be investigated for criminal responsibility. In a two-year campaign to crack down on illegal practice of medicine, the health sector mainly depends on the work, which is not strong enough. The most illegal behavior of licensed medical institutions is the use of non-health personnel, beyond the scope to carry out diagnosis and treatment activities, medical institutions illegally publish medical advertisements, lease contracted departments. Conclusion and suggestion: it is necessary to treat illegal medical practice with both symptoms and comprehensive treatment. On the one hand, we should perfect laws and regulations, establish a policy system to prevent and crack down on illegal practice of medicine, further improve the level of law enforcement, and explore a long-term supervision mechanism. On the other hand, the basic way out is for the government to increase the necessary input and take up the responsibility of meeting the basic medical needs of the masses, especially to establish a medical security system for migrant workers and vulnerable groups. In order to achieve the effect of long-term control, the combination of prevention and control should be adopted in order to cut off the soil of illegal medical practice from the source and the root, and to regulate the medical order reasonably.
