　　本文是《拉多吉卡·巴茨科訴克里斯·阿克赫斯特》判決書的翻譯實踐報告。該判決書主要內(nèi)容是法官針對澳大利亞新南威爾士州一起交通事故引起的民事索賠糾紛而進(jìn)行的判決。原文本中大量引用判例和成文法,經(jīng)常使用專業(yè)術(shù)語和長難句。另外,源文本中法庭主要參與人員的語言風(fēng)格也各不相同。這些既是源文本的主要特點,也是翻譯中的難點。對此,本次翻譯實踐在功能對等理論的指導(dǎo)下,使用順句翻譯法、句式重構(gòu)法、求同存異法、增譯法、拆分法、轉(zhuǎn)類法、被動轉(zhuǎn)主動法等各種翻譯方法傳遞出源文本的語義,同時盡最大限度表達(dá)出源文本的風(fēng)格。在翻譯過程中成功解決了以下問題:1.引用判例的翻譯;2.法律條文編碼的翻譯;3.專業(yè)術(shù)語的翻譯;4.長難句的翻譯;5.法庭主要參與人員語言風(fēng)格的翻譯。本翻譯實踐報告通過展示作者如何利用所掌握的翻譯方法解決翻譯實踐中翻譯難點,對翻譯澳大利亞有關(guān)交通事故判決書的譯員具有參考意義,為國內(nèi)法律實踐者提供澳大利亞法官在交通事故爭議處理方面的借鑒。同時,本報告對中澳兩國案例的法學(xué)研究也具有一定的意義。然而,由于源文本資料有限,法律條文編碼的翻譯只在本次的翻譯實踐中出現(xiàn)的條款編碼中適用,在整部法律中的適用程度還需...
