本文是《拉多吉卡·巴茨科訴克里斯·阿克赫斯特》判決書(shū)的翻譯實(shí)踐報(bào)告。該判決書(shū)主要內(nèi)容是法官針對(duì)澳大利亞新南威爾士州一起交通事故引起的民事索賠糾紛而進(jìn)行的判決。原文本中大量引用判例和成文法,經(jīng)常使用專(zhuān)業(yè)術(shù)語(yǔ)和長(zhǎng)難句。另外,源文本中法庭主要參與人員的語(yǔ)言風(fēng)格也各不相同。這些既是源文本的主要特點(diǎn),也是翻譯中的難點(diǎn)。對(duì)此,本次翻譯實(shí)踐在功能對(duì)等理論的指導(dǎo)下,使用順句翻譯法、句式重構(gòu)法、求同存異法、增譯法、拆分法、轉(zhuǎn)類(lèi)法、被動(dòng)轉(zhuǎn)主動(dòng)法等各種翻譯方法傳遞出源文本的語(yǔ)義,同時(shí)盡最大限度表達(dá)出源文本的風(fēng)格。在翻譯過(guò)程中成功解決了以下問(wèn)題:1.引用判例的翻譯;2.法律條文編碼的翻譯;3.專(zhuān)業(yè)術(shù)語(yǔ)的翻譯;4.長(zhǎng)難句的翻譯;5.法庭主要參與人員語(yǔ)言風(fēng)格的翻譯。本翻譯實(shí)踐報(bào)告通過(guò)展示作者如何利用所掌握的翻譯方法解決翻譯實(shí)踐中翻譯難點(diǎn),對(duì)翻譯澳大利亞有關(guān)交通事故判決書(shū)的譯員具有參考意義,為國(guó)內(nèi)法律實(shí)踐者提供澳大利亞法官在交通事故爭(zhēng)議處理方面的借鑒。同時(shí),本報(bào)告對(duì)中澳兩國(guó)案例的法學(xué)研究也具有一定的意義。然而,由于源文本資料有限,法律條文編碼的翻譯只在本次的翻譯實(shí)踐中出現(xiàn)的條款編碼中適用,在整部法律中的適用程度還需...
