【摘要】：隨著中國改革開放步伐加快,人們開始認識到在經(jīng)濟、政治、學術(shù)和文化方面開展國際交流與合作的重要性。對立法文件和法律學術(shù)著作的翻譯體現(xiàn)了中國和其他國家在上述領(lǐng)域的合作。法律翻譯雖然源遠流長,卻由于法律語言獨有的特點以及英漢兩種語言的巨大差異面臨重重困難。因此對法律文本的翻譯進行研究極為必要。作者從其自身的翻譯實踐中認識到法律翻譯者除了要熟練掌握英漢語言之外,還應學習一些法律基本知識。由萊思提出的文本類型理論是一個重要的翻譯理論,并且對翻譯分析與評估有積極的作用。萊思認為有必要對文本進行分類以指導翻譯實踐,因為不同類型的文本存在很大的差異。在語言功能分類的基礎(chǔ)上,她將文本分為三類,即:信息型文本,表達型文本和感召型文本。還提出了針對三種文本的翻譯標準和方法。信息型文本的翻譯最重要的是保存原文的主要內(nèi)容。翻譯表達型文本時,譯文應試圖傳達與原文相同的情感。而感召型文本則以達到與原文類似的效果為評價標準。文本類型理論認為不應規(guī)定一種翻譯方法而應根據(jù)不同的文本選擇翻譯方法。作為一種特殊的專業(yè)文本,將文本類型理論運用于法律文本的研究具有重要意義。翻譯材料選自Natalie Klein的《聯(lián)合國海洋法公約框架下的爭端解決方式》一書。該書介紹了聯(lián)合國海洋法公約中的爭端解決程序,如何將爭端解決機制運用于關(guān)于自由航行和海洋資源的保護等實際問題中。本文試圖通過分析翻譯材料中的例子,將文本類型理論運用于國際法律文本翻譯之中。筆者針對條款詞語、同義重復詞語、法律專業(yè)術(shù)語、長難句、被動語態(tài)以及名詞化結(jié)構(gòu)提出了不同的翻譯方法。筆者希望本研究能為致力成為專業(yè)法律翻譯和想提高法律翻譯技能的人們提供一些幫助。
[Abstract]:With the acceleration of China's reform and opening-up, people began to realize the importance of international exchanges and cooperation in economic, political, academic and cultural fields. The translation of legislative documents and legal academic works reflects the cooperation between China and other countries in these fields. Although legal translation has a long history, it faces many difficulties due to the unique characteristics of legal language and the great differences between English and Chinese. Therefore, it is very necessary to study the translation of legal texts. From his own translation practice, the author realizes that legal translators should not only master the English and Chinese languages, but also learn some basic knowledge of law. The text typology theory put forward by Leith is an important translation theory and plays a positive role in translation analysis and evaluation. Lyth believes that it is necessary to classify texts to guide translation practice, because there are great differences among different types of texts. Based on the classification of language functions, she classifies texts into three categories: informational text, expressive text and inspiring text. The translation criteria and methods for the three texts are also proposed. The most important thing in the translation of informational text is to preserve the main content of the original text. When translating expressive texts, the translation should try to convey the same emotion as the original text. On the other hand, the inspiring text takes the effect similar to that of the original text as the evaluation criterion. According to the text type theory, a translation method should be chosen according to different texts rather than a translation method. As a special professional text, it is of great significance to apply the theory of text types to the study of legal texts. Translation materials are drawn from Natalie Klein's "dispute settlement in the framework of UNCLOS". The book introduces the dispute settlement procedure in the United Nations Convention on the Law of the Sea and how to apply the dispute settlement mechanism to practical issues such as the freedom of navigation and the protection of marine resources. This paper attempts to apply the text typology theory to the translation of international legal texts by analyzing examples in translation materials. The author puts forward different translation methods for clause words, synonymous repetition words, legal professional terms, long and difficult sentences, passive voice and nominalization structure. The author hopes that this study can provide some help for people who are committed to professional legal translation and want to improve their legal translation skills.
