【摘要】：清朝養(yǎng)廉銀制度是在雍正時期推行的一項政策,以此來改變官員俸祿低、吏治腐敗的現(xiàn)象。通過給官員發(fā)放高于正俸幾倍甚至幾十倍的養(yǎng)廉銀兩讓官員專心于政務、維護地方的穩(wěn)定。通過養(yǎng)廉銀立法的實施,朝廷內(nèi)外得以清明、鞏固了政權,取得很好的效果。但是,隨著養(yǎng)廉銀制度實施的不斷深入,其存在的弊端也漸漸顯露出來,在乾隆后期甚至導致更嚴重的腐敗,養(yǎng)廉銀并不能養(yǎng)廉。本文的研究從引言入手,對養(yǎng)廉銀立法的研究主要包括三大部分,首先介紹了養(yǎng)廉銀的立法背景,背景的研究主要圍繞政治背景、思想背景、制度背景、社會背景這四個大方向展開。養(yǎng)廉銀立法是清朝特殊歷史背景條件下的產(chǎn)物,因此深入研究養(yǎng)廉銀立法背景有助于我們?nèi)轿涣私怵B(yǎng)廉銀制度的精神。其次本文主要研究的是養(yǎng)廉銀立法的內(nèi)容,這是本文研究的重點。財政基礎和支取制度這兩個方面是養(yǎng)廉銀立法的主要內(nèi)容,其中財政基礎主要介紹的是耗羨歸公制度。因為耗羨歸公制度是養(yǎng)廉銀最主要的財政來源,包括耗羨歸公的原則、比率標準、范圍以及用途等幾個方面的內(nèi)容。養(yǎng)廉銀的支取制度主要圍繞養(yǎng)廉銀發(fā)放的原則、對象、數(shù)額進行研究,力求對養(yǎng)廉銀的內(nèi)容有一個詳細、全面的介紹。最后,本文的研究主要圍繞兩個方面展開,一是養(yǎng)廉銀立法的實施效果,二是對當代的啟示。養(yǎng)廉銀立法實施的效果包括積極效果以及存在的弊端,養(yǎng)廉銀立法實施的弊端是本文研究的重點,通過分析其存在的弊端才能更好地為當代所用。養(yǎng)廉銀立法實施的啟示是把清朝養(yǎng)廉銀與當代反腐相結合,以史為鑒,通過全面分析養(yǎng)廉銀立法更好地為當代服務,以期為當代反腐做出一定的貢獻。
[Abstract]:In the Qing Dynasty, the system of keeping honest banks was carried out in the Yongzheng period to change the low salaries of officials. The phenomenon of official corruption. By paying officials several times or even tens of times higher than the official salary to raise the bank to allow officials to concentrate on government affairs and maintain local stability. Through the implementation of legislation to protect the integrity of the bank Pure Brightness inside and outside the court. Consolidated the regime, achieved good results. However, with the continuous implementation of the system of Lian Lian silver, its shortcomings also gradually revealed, in the late Qianlong even led to more serious corruption. The research of this paper begins with the introduction, and the research on the legislation of the bank mainly includes three parts. Firstly, the legislative background of the bank is introduced, and the research of the background mainly revolves around the political background. Ideological background, institutional background, social background of the four major directions. Lian Yin legislation is the Qing Dynasty under the special historical background of the product. Therefore, in-depth study of the legislative background of lien-rearing silver is helpful for us to understand the spirit of the system. Secondly, this paper mainly studies the content of legislation. This is the focus of this study. The financial basis and the withdrawal system are the main contents of the legislation. Among them, the financial foundation mainly introduces the system of "returning to public with envy", because it is the most important source of finance for the bank, including the principle of "returning to public with envy" and the standard of ratio. The scope and use of several aspects of the content. The payment system of lien silver mainly around the principles, objects, the amount of research, strive to raise the content of Lian silver have a detailed, comprehensive introduction. Finally. The research of this paper mainly focuses on two aspects, one is the implementation effect of the legislation, the other is the enlightenment to the contemporary era. The effect of the legislation implementation includes the positive effect as well as the shortcomings. The disadvantages of the legislation implementation is the focus of this study, through the analysis of its shortcomings, it can be better used for the contemporary. The enlightenment of the legislation implementation is to combine the Qing Dynasty with the contemporary anti-corruption. Taking history as a mirror, we can make a contribution to anti-corruption by analyzing the legislation of Lian Lian Bank.
