【摘要】：買賣契約是中國古代最重要的民事契約之一。為了保障交易安全,保證買賣之債的實現(xiàn),官府法令與民間習慣均要求買賣雙方尤其是賣方必須在契約訂立時明確各類擔保條款。古文獻資料記載和出土文物資料顯示,我國古代買賣契約中常見的擔保方式為瑕疵擔保、追奪擔保、恩赦擔保和信用擔保。傳統(tǒng)買賣之債的擔保制度,在今天除恩赦擔保完全失去價值外,其余則對現(xiàn)代市場經(jīng)濟進一步培育誠信公平理念,仍具有一定的借鑒意義。
[Abstract]:Sale and purchase contract is one of the most important civil contracts in ancient China. In order to ensure the security of the transaction and the realization of the sale debt, both the government decree and the folk custom require both the buyer and the seller, especially the seller, to define all kinds of security clauses when the contract is concluded. According to the records of ancient documents and unearthed cultural relics, the common forms of guarantee in the ancient sale and purchase contract of our country are defect guarantee, recovery guarantee, pardon guarantee and credit guarantee. The traditional guarantee system of debt bought and sold, except forgiving guarantee has lost its value completely today, but it still has certain reference significance for the modern market economy to further cultivate the concept of honesty and fairness.
