行政倫理價值與行政人格研究

【摘要】:行政倫理價值作為公共行政領(lǐng)域認同的普遍信念,已成為評價行政行為的重要依據(jù)。對行政權(quán)力的制約,不僅要通過法律和分權(quán)等制度結(jié)構(gòu)以及社會力量等外在的他律,而且需要內(nèi)在的道德自律作為輔助。民主行政的外在制度性他律與行政人員的道德自律,二者相輔相承,互相配合,才能建構(gòu)行政倫理體系并使其價值得以實現(xiàn)。 行政倫理價值取向是在一定的行政倫理觀與行政價值觀的指引下形成的,正確的行政倫理價值觀為政府及其行政人員的價值取向提供了既定可行的引導。行政人格作為行政倫理的目標價值取向,是以公共利益為基礎(chǔ)價值取向,以公共責任為核心價值取向,以社會公正為根本價值取向的前提之下,進一步體現(xiàn)行政主體的主動性以及保證政府行政行為合法化的內(nèi)在約束力。這四個方面的價值取向?qū)狞c現(xiàn)實要求:廉潔奉公、勤政為民;角色調(diào)節(jié)、責權(quán)統(tǒng)一;求真務(wù)實、公平正義;提高德性、鑄就品格。 從歷史發(fā)展的角度來看,行政人格的形成具有法律、理性、信念等依據(jù),并且可以區(qū)分為依附性、工具性和獨立性三種不同的行政人格模式,其中,獨立性行政人格是行政倫理價值取向所應追求的新型人格。獨立性行政人格具有明確的自我意識、知識能力、道德品行三要素以及公共性、獨立性、服務(wù)性、責任性四個特質(zhì),并由此形成一整套有關(guān)獨立性行政人格生成的體系:行政價值目標導向行政自律形成;行政制度力求保證行政合法環(huán)境;行政主體逐步提高行為選擇能力;行政主體自覺進行自我道德修養(yǎng)。 行政倫理價值與行政人格的相互關(guān)系主要表現(xiàn)為:行政倫理價值的實現(xiàn)以完善行政人格為首要目標;行政人格又促成良好行政過程,是行政倫理價值實現(xiàn)的內(nèi)在驅(qū)動力量。所以把握行政人格與行政倫理價值之間的互動關(guān)系是行政倫理體系得以建構(gòu)的關(guān)鍵因素,并且具有非常重要的現(xiàn)實意義。
[Abstract]:Administrative ethical value, as a common belief in public administration, has become an important basis for evaluating administrative behavior. The restriction of administrative power should not only pass the system structure such as law and separation of powers, but also need the inner moral self-discipline as the assistant. The external institutional heteronomy of democratic administration and the moral self-discipline of administrative staff complement and cooperate with each other in order to construct the administrative ethics system and realize its value. The value orientation of administrative ethics is formed under the guidance of certain administrative ethics and administrative values. The correct value of administrative ethics provides a definite and feasible guide for the value orientation of the government and its administrative staff. As the objective value orientation of administrative ethics, administrative personality is based on the public interest, public responsibility as the core value orientation, social justice as the fundamental value orientation, under the premise of public interest as the basic value orientation, public responsibility as the core value orientation, social justice as the fundamental value orientation. It further embodies the initiative of the administrative subject and the internal binding force to guarantee the legalization of the government's administrative action. The value orientation of these four aspects corresponds to four practical requirements: honest and honest, diligent for the people; role regulation, unity of responsibility and power; seeking truth and pragmatism, fairness and justice; improving virtue and casting character. From the perspective of historical development, the formation of administrative personality has legal, rational, belief and other basis, and can be divided into three different administrative personality models: dependence, instrumentality and independence. Independent administrative personality is a new type of personality which should be pursued by the value orientation of administrative ethics. The independent administrative personality has four characteristics: self-consciousness, knowledge ability, moral character, publicity, independence, service and responsibility. And form a whole set of independent administrative personality generation system: the goal of administrative value leads to the formation of administrative self-discipline; The administrative system strives to ensure the legal environment of administration, the administrative subject gradually improves the ability of behavior choice, and the administrative subject consciously carries out self-cultivation of morality. The relationship between the administrative ethical value and the administrative personality is mainly manifested as follows: the realization of the administrative ethical value takes the perfection of the administrative personality as the primary goal, and the administrative personality promotes the good administrative process, which is the internal driving force for the realization of the administrative ethical value. Therefore, to grasp the interaction between administrative personality and administrative ethical value is the key factor to construct the administrative ethics system, and has very important practical significance.
