【摘要】：現(xiàn)代性的正義觀以個(gè)體權(quán)利為基點(diǎn),認(rèn)為市場經(jīng)濟(jì)可以為實(shí)現(xiàn)個(gè)人權(quán)利提供基礎(chǔ)和環(huán)境,在市場經(jīng)濟(jì)條件下,每個(gè)人都以物的形式占有社會(huì)權(quán)利,即市場社會(huì)提供給人們的可支配性資源。市場社會(huì)通過商業(yè)、奢侈、貨幣、交換價(jià)值等普遍形式,使個(gè)人權(quán)利得到肯定和滿足。市場經(jīng)濟(jì)按績分配實(shí)現(xiàn)的程序正義,為個(gè)體成長和發(fā)展提供平等的機(jī)會(huì),使現(xiàn)代人能夠在各種可能性之間進(jìn)行自由的選擇,并為自己的選擇承擔(dān)責(zé)任。在資本邏輯主導(dǎo)的市場社會(huì)中,國家僅僅建立一個(gè)程序化的框架,讓自由的個(gè)體在其中全憑自己的能力進(jìn)行競爭,并由個(gè)體自身承擔(dān)競爭帶來的后果,這必然會(huì)導(dǎo)致程序正義的一元化和實(shí)質(zhì)正義的虛無。
[Abstract]:The concept of justice in modernity is based on individual rights and holds that the market economy can provide the basis and environment for the realization of individual rights. Under the condition of the market economy, everyone possesses social rights in the form of things, that is, the disposable resources that the market society provides to people. The procedural justice of market economy distribution according to achievements provides equal opportunities for individual growth and development, enables modern people to make free choices among various possibilities and take responsibility for their own choices. The ordered framework allows free individuals to compete on their own and bear the consequences of competition, which will inevitably lead to the unification of procedural justice and the nothingness of substantive justice.
