【摘要】：通過提出明示同意與默示同意這兩個(gè)不同的同意概念并強(qiáng)調(diào)有別于集體同意之個(gè)體同意的重要性,特別是通過對(duì)默示同意的分析和說明,洛克使得近代意義上的同意理論逐漸浮出水面。同意理論在顛覆君權(quán)神授理論、確認(rèn)人民主權(quán)思想的過程中有著無可置疑的歷史價(jià)值。雖然在現(xiàn)當(dāng)代,同意理論因遭遇到越來越多的詬病而逐漸步入困境,但同意理論并非一無是處。對(duì)于當(dāng)代中國社會(huì)來說,強(qiáng)調(diào)政府及政府行為必須經(jīng)過人民的同意這一點(diǎn),對(duì)于政治體制的改革以及政治秩序的合法構(gòu)建來說仍然具有極為重要且深遠(yuǎn)的意義。
[Abstract]:By developing two distinct concepts of consent, express consent and implied consent, and stressing the importance of individual consent as distinct from collective consent, in particular through analysis and explanation of implied consent, Locke brought the modern theory of consent to the surface. The theory of consent has an indisputable historical value in the process of subverting the divine doctrine of monarchy and confirming the thought of people's sovereignty. Although the theory of consent has gradually stepped into a dilemma because of more and more criticism in modern times, consent theory is not useless. For the contemporary Chinese society, it is still of great importance and far-reaching significance to emphasize that the government and its behavior must be approved by the people, which is still of great importance to the reform of the political system and the legal construction of the political order.
