中國近代化語境下的“民權(quán)”概念考

【摘要】:中國近代化語境下的民權(quán)是受西方代議制民主影響,同時又與中國傳統(tǒng)的民本主義相嫁接,而產(chǎn)生的既不同于西方近代的人權(quán),又不同于西方民主的一個亦中亦西的概念。改良主義的民權(quán)話語的涵義主要是"人人有自主之權(quán)"。與以個人為本位、以調(diào)解個人權(quán)利和國家權(quán)力關(guān)系為目的的人權(quán)相比,改良主義者言說的民權(quán)主要以群為基礎(chǔ),以重塑君臣關(guān)系為目的;與以解決國家權(quán)力合法性問題的民主相比,改良主義者言說的民權(quán)則力圖將儒家的民本主義與民主相調(diào)和。革命主義者所言說的民權(quán)同樣并非西方意義上的人權(quán),亦非公民權(quán),而是指國民權(quán),人民主權(quán)被言說成了"主權(quán)在民",即人民作為整體被迅速提升為國家主人,同時人民仍然是需要被政治精英所引導的傳統(tǒng)意義上的"民"。
[Abstract]:The civil rights in the context of Chinese modernization are influenced by the western representative democracy and grafted with the Chinese traditional people-oriented doctrine, which is different from the western modern human rights as well as the concept of western democracy. The main meaning of the civil rights discourse of reformism is "everyone has the right to autonomy". Compared with the human rights which take the individual as the standard and mediate the personal rights and the state power relations, the civil rights of the reformists mainly take the group as the foundation, with the aim of remoulding the relationship between the monarch and the subject. Compared with democracy, which solves the legitimacy of state power, the civil rights of reformists try to reconcile the Confucian people-oriented doctrine with democracy. The civil rights of the revolutionaries are also not human rights in the western sense, nor are they citizens' rights. The sovereignty of the people is described as "sovereignty in the people", that is, the people as a whole are rapidly promoted to the masters of the country. At the same time, the people still need to be guided by the political elite in the traditional sense of the people.
