【摘要】：從現(xiàn)代民主立憲社會的政治文化傳統(tǒng)出發(fā)，約翰·羅爾斯認為，當(dāng)代社會是一個理性多元化的社會，這是一個無法改變的事實。在政治多元化、文化多元化、價值多元化發(fā)展的今天，擁有公共理性的現(xiàn)代公民可以就“政治的正義”觀念達成一種“重疊共識”。 重疊共識理念作為羅爾斯在《政治自由主義》一書中提出的三個主要理念（重疊共識理念、權(quán)利優(yōu)先性和善的理念、公共理性理念）之一，它是羅爾斯政治哲學(xué)體系的基礎(chǔ)。重疊共識是指在多元化的現(xiàn)代民主社會里，具有公共理性的公民在持有各自合乎理性的哲學(xué)學(xué)說、宗教學(xué)說和道德學(xué)說的同時，尋求相互之間的共識面，以達成對政治正義觀念的一致。在羅爾斯看來，公民所達成的合乎理性的重疊共識能夠為現(xiàn)代民主社會提供穩(wěn)定性的支持。 本文以《政治自由主義》一書中重疊共識理念內(nèi)容的文本解讀為基礎(chǔ)，，并借鑒學(xué)術(shù)界既有的研究成果，試就羅爾斯的重疊共識理念進行分析探究。全文的主體部分共分為三大部分：第一部分從歷史入手，通過對洛克、盧梭和康德等人的介紹，找尋了重疊共識的理論來源以及全面分析了羅爾斯提出的“重疊共識”理念的歷史背景；第二部分詳細闡釋了重疊共識的基本涵義以及與權(quán)利的優(yōu)先性于善、公共理性之間的內(nèi)在聯(lián)系，并且闡述了重疊共識理念實現(xiàn)的可能性；第三部分主要評析了這一共識思想的合理性以及學(xué)者們對它引起的爭論，并指出該思想的現(xiàn)實價值。筆者認為，這一研究不僅有助于共識理論的豐富與發(fā)展，同時也可為我們今天建設(shè)社會主義和諧社會提供一些有意義的啟示與借鑒。
[Abstract]:Starting from the political and cultural tradition of modern democratic constitutional society, John Rawls believes that the contemporary society is a rational and pluralistic society, which is an irrevocable fact. With the development of political pluralism, cultural pluralism and value diversification, modern citizens with public rationality can reach an "overlapping consensus" on the concept of "political justice". As one of the three main ideas put forward by Rawls in his book political Liberalism, the idea of overlapping consensus, the idea of priority of rights and the idea of public rationality, it is the foundation of Rawls' political philosophy system. Overlapping consensus means that in a pluralistic modern democratic society, citizens with public rationality seek mutual consensus while holding their own rational philosophical, religious and moral doctrines. To reach a consensus on the idea of political justice. In Rawls' view, the rational overlapping consensus reached by citizens can provide stability support for a modern democratic society. Based on the text interpretation of the idea of overlapping consensus in political Liberalism, and drawing on the existing research results in academic circles, this paper tries to analyze Rawls' idea of overlapping consensus. The main part of the thesis is divided into three parts: the first part begins with history, through the introduction of Locke, Rousseau and Kant, etc. This paper finds out the theoretical source of overlapping consensus and analyzes the historical background of the concept of overlapping consensus put forward by Rawls. The second part explains the basic meaning of overlapping consensus and the priority of rights over good. The third part mainly analyzes the rationality of this idea and the controversy caused by scholars, and points out the practical value of the idea. The author thinks that this research not only contributes to the enrichment and development of consensus theory, but also provides us with some meaningful enlightenment and reference for the construction of socialist harmonious society today.
