【摘要】： 正義是哲學關注的永恒焦點。在近代以前,正義一詞主要是作為人之行為的評價標準而存在;近代以后,正義的概念則被越來越多地被專門用作評價社會制度。程序正義作為正義的重要表現(xiàn)形式,一直是東西方學界研究的熱點,當代正義理論的集大成者羅爾斯從分配正義入手,把程序正義的概念導入到自己的正義體系當中,具有劃時代的意義。然而,正所謂“譽滿天下,謗滿天下”,羅爾斯通過超歷史主義手法構(gòu)建的正義價值體系也受到了東西方學者的廣泛批評。 在我們看來,正義原則的前提和根據(jù)只能在人類的歷史中去尋找。因此,本文將以馬克思的唯物史觀為理論依據(jù),通過生產(chǎn)力與生產(chǎn)關系的基本運動來探討政治意義上程序正義的可行性、必要性與可能性,闡釋程序正義在不同的歷史時期表現(xiàn)出的具體形態(tài),并指明政治意義上程序正義的局限性及其歷史超越。最后,立足于政治意義上程序正義唯物史觀的分析,我們將展開對現(xiàn)在程序正義理念的分析討論,梳理其條件,整合其要素,闡釋其理念,并論證程序正義與實質(zhì)正義的關系。
[Abstract]:Justice is the eternal focus of philosophical concern. Before modern times, the term justice mainly existed as the evaluation standard of human behavior. The concept of justice is more and more used to evaluate the social system. As an important manifestation of justice, procedural justice has always been a hot research topic in the field of eastern and western scholars. Rawls, the master of contemporary justice theory, begins with the distribution of justice. It is of epoch-making significance to introduce the concept of procedural justice into one's own justice system. The justice value system constructed by Rawls through super-historicism has also been widely criticized by western and eastern scholars. In our view, the premise and basis of the principle of justice can only be found in the history of mankind. Therefore, this paper will take Marx's historical materialism as the theoretical basis. Through the basic movement of productive forces and relations of production, this paper discusses the feasibility, necessity and possibility of procedural justice in the political sense, and explains the concrete forms of procedural justice in different historical periods. Finally, based on the analysis of the historical materialism of procedural justice in the political sense, we will discuss the concept of procedural justice and sort out its conditions. Integrate its elements, explain its concept, and demonstrate the relationship between procedural justice and substantive justice.
