【摘要】：海權(quán)是一個(gè)重要的歷史因素或者說(shuō)是歷史過(guò)程,它不是一種孤立于歷史而存在的抽象物,而是與利用和控制海洋的競(jìng)爭(zhēng)或斗爭(zhēng)相聯(lián)系的。歷史上關(guān)于國(guó)家利用和控制海洋的競(jìng)爭(zhēng)或斗爭(zhēng)的最好形式往往表現(xiàn)為戰(zhàn)爭(zhēng),所以可以說(shuō),“海權(quán)的歷史主要是一部軍事史”。本文第一章節(jié)討論有關(guān)海權(quán)的形成與定義,進(jìn)而探討海權(quán)的控制,引出第二章節(jié)維護(hù)海權(quán)的海上力量。 《聯(lián)合國(guó)海洋法公約》出臺(tái)之后,作為海陸兼?zhèn)涞乃{(lán)色國(guó)土,海島已經(jīng)已成為維護(hù)海權(quán)的重要關(guān)注焦點(diǎn)。無(wú)居民海島兼具軍事海權(quán)和經(jīng)濟(jì)海權(quán)的統(tǒng)一,對(duì)于維護(hù)我國(guó)海洋國(guó)土有著重要意義。第三章重點(diǎn)敘述以無(wú)居民海島為重點(diǎn)的海島權(quán)益與海權(quán)維護(hù)之間的緊密關(guān)系。首先從國(guó)際關(guān)系建構(gòu)主義角度理解國(guó)際法對(duì)于海島的定義,其次詳細(xì)說(shuō)明無(wú)居民海島對(duì)于海權(quán)維護(hù)的重要意義,從法學(xué)角度解釋有居民海島和無(wú)居民海島劃分的由來(lái)和定義、有居民海島和無(wú)居民海島的不同劃分對(duì)海島所有權(quán)的歸屬進(jìn)行分析,以及有居民海島和無(wú)居民海島的劃分對(duì)海島權(quán)屬關(guān)系的影響。從國(guó)際關(guān)系角度看無(wú)居民海島開發(fā)與保護(hù)的重要性。
[Abstract]:Sea power is an important historical factor or a historical process. It is not an abstract object isolated from history, but is related to the competition or struggle to use and control the sea. In history, the best form of competition or struggle for the use and control of the sea by a country is often manifested in war, so it can be said that "the history of sea power is mainly a military history". The first chapter discusses the formation and definition of sea power, and then discusses the control of sea power. After the United Nations Convention on the Law of the Sea (UNCLOS) came into being, as a blue land with both sea and land, the island has become an important focus of attention for the protection of maritime power. Non-inhabitant islands have the unity of military sea power and economic sea power, which is of great significance to the maintenance of our country's marine land. The third chapter focuses on the close relationship between the rights and interests of uninhabited islands and the maintenance of sea rights. First of all, from the perspective of international relations constructivism to understand the international law of the definition of islands, and then to explain the importance of non-resident islands for the maintenance of maritime rights, from the perspective of law to explain the origin and definition of the division of inhabited islands and non-resident islands. The ownership of the islands is analyzed according to the different division of the islands with and without inhabitants, and the influence of the division of the islands with and without inhabitants on the ownership of the islands is also analyzed. The importance of the development and protection of uninhabited islands from the angle of international relations.
