【摘要】：自美國建國以來,美國領(lǐng)事保護(hù)隨著國家的發(fā)展不斷改進(jìn)和完善。特別是在冷戰(zhàn)結(jié)束后,兩極格局的瓦解,計算機(jī)和信息技術(shù)的飛速發(fā)展為全球化的深化帶來了契機(jī)。商品、資金、信息和人員在全球范圍內(nèi)的流動更加方便,越來越多的美國公民和企業(yè)走出國門尋求新的機(jī)遇,領(lǐng)事保護(hù)任務(wù)也日益繁重。為解決這一問題,美國領(lǐng)事保護(hù)發(fā)生了一次重大的轉(zhuǎn)變。美國領(lǐng)事保護(hù)的工作重心從被動應(yīng)對轉(zhuǎn)向主動預(yù)防,工作的方式從單一實(shí)施變?yōu)槎喾絽⑴c。由于當(dāng)下中國領(lǐng)事保護(hù)在發(fā)展的過程中所面臨的挑戰(zhàn)和轉(zhuǎn)變與美國所面臨過的挑戰(zhàn)和轉(zhuǎn)變較為相似。所以本文以美國領(lǐng)事保護(hù)為研究對象,一方面對美國領(lǐng)事保護(hù)的歷史沿革進(jìn)行了概述,將美國領(lǐng)事保護(hù)發(fā)展歷史分成了三階段進(jìn)行闡述,分析了其中的變遷性和延續(xù)性,并且著重分析了冷戰(zhàn)結(jié)束后轉(zhuǎn)變的原因。另一方面對當(dāng)前美國領(lǐng)事保護(hù)的優(yōu)勢和問題進(jìn)行了總結(jié),并對轉(zhuǎn)變后的效果進(jìn)行了評估。最后,通過對中美兩國領(lǐng)事保護(hù)的差異分析,給予了當(dāng)代中國領(lǐng)事保護(hù)建設(shè)一些啟示性建議。
[Abstract]:Since the founding of the United States, consular protection in the United States has been improved and perfected with the development of the country. Especially after the end of the cold war, the collapse of the bipolar structure and the rapid development of computer and information technology have brought opportunities for the deepening of globalization. In order to solve this problem, consular protection in the United States has undergone a major transformation. The focus of American consular protection has shifted from passive response to active prevention. The way of work has changed from single implementation to multi-party participation. The challenges and changes in the process of development are similar to those faced by the United States. Therefore, this paper takes the United States consular protection as the research object. On the one hand, the historical evolution of the United States consular protection is summarized, and the development history of the United States consular protection is divided into three stages to elaborate, and the changes are analyzed. On the other hand, it summarizes the advantages and problems of consular protection in the United States, and evaluates the effect of the transformation. Finally, it gives some enlightening suggestions to the construction of consular protection in contemporary China by analyzing the differences between the two countries.
