【摘要】：日本"集體自衛(wèi)權(quán)"問(wèn)題的根源,在于對(duì)和平憲法第9條的認(rèn)知與解釋。憲法第9條明確宣布放棄行使集體自衛(wèi)權(quán),歷屆內(nèi)閣也都遵循這一規(guī)定。然而急欲擺脫戰(zhàn)后體制的束縛,實(shí)現(xiàn)日本"普通國(guó)家化"的安倍,執(zhí)意通過(guò)修改憲法解釋的方式解禁集體自衛(wèi)權(quán)。這不僅超出了內(nèi)閣對(duì)于憲法解釋的權(quán)限,而且違反了和平憲法所倡導(dǎo)的和平主義精神,必將對(duì)日本國(guó)家安全政策走向亞太地區(qū)安全形勢(shì)產(chǎn)生影響。
[Abstract]:The root of Japan's "right of collective self-defense" lies in its understanding and interpretation of Article 9 of the Constitution of Peace. Article 9 of the Constitution expressly renounces the exercise of the right to collective self-defence, which successive cabinets have followed. However, eager to get rid of the shackles of the postwar system and to realize the "common nationalization" of Japan, Abe insisted on lifting the right of collective self-defense by modifying the constitutional interpretation. This not only exceeds the power of the cabinet to interpret the constitution, but also violates the pacifist spirit advocated by the pacifist constitution, and will certainly have an impact on the security situation of Japan's national security policy toward the Asia-Pacific region.
