論澳大利亞和東帝汶關(guān)于帝汶海海洋劃界和資源爭(zhēng)端的解決

【摘要】: 海洋劃界和資源糾紛一直是國(guó)際關(guān)系和國(guó)際法研究領(lǐng)域的熱點(diǎn)。澳大利亞和東帝汶之間的帝汶海爭(zhēng)端就是典型的以爭(zhēng)奪資源占有和分配權(quán)為中心的海洋領(lǐng)土爭(zhēng)端,該爭(zhēng)端以其自身獨(dú)特的復(fù)雜性吸引了國(guó)際社會(huì)的廣泛關(guān)注。澳東帝汶海爭(zhēng)端的特殊性和復(fù)雜性主要體現(xiàn)在兩個(gè)方面,一是劃界和資源爭(zhēng)端與東帝汶的政治演變過程交織在一起,二是爭(zhēng)端雙方存在明顯的實(shí)力差距。 澳東帝汶海爭(zhēng)端是通過外交談判的方式解決的。談判歷時(shí)六年多之久,過程曲折而復(fù)雜,最終雙方同意暫時(shí)擱置主權(quán)爭(zhēng)議,在共同合作區(qū)范圍內(nèi)對(duì)爭(zhēng)端海域的油氣資源進(jìn)行共同開發(fā),并就有關(guān)制度安排簽訂了條約,為油氣資源開發(fā)活動(dòng)提供了穩(wěn)定的法律依據(jù)。這一結(jié)果的達(dá)成是雙方互相妥協(xié)的結(jié)果,在一定程度上使雙方的利益都得到了滿足。但深入探討不難發(fā)現(xiàn),雖然澳大利亞和東帝汶是兩個(gè)實(shí)力懸殊的談判力量,而且東帝汶的國(guó)家發(fā)展對(duì)澳大利亞的援助還存在較強(qiáng)的依賴性,但是在整個(gè)談判過程中,澳大利亞卻一直屬于相對(duì)被動(dòng)的一方,最后的談判結(jié)果與澳大利亞最初的談判目標(biāo)相距甚遠(yuǎn)。 本文將對(duì)澳東帝汶海爭(zhēng)端的來龍去脈做出深入分析。以東帝汶的國(guó)家獨(dú)立和發(fā)展史為時(shí)間軸線,探討葡屬東帝汶時(shí)期、印尼非法占領(lǐng)時(shí)期、聯(lián)合國(guó)過渡管理時(shí)期以及東帝汶正式獨(dú)立后四個(gè)時(shí)期內(nèi)帝汶爭(zhēng)端的解決情況,總結(jié)出澳東帝汶海爭(zhēng)端的解決思路以及制約雙方談判行為選擇的因素,特別是對(duì)雙方為什么會(huì)在談判中妥協(xié)作出合理解釋。
[Abstract]:Maritime delimitation and resource disputes have always been a hot topic in the field of international relations and international law. The Timor Sea dispute between Australia and East Timor is a typical maritime territorial dispute centered on the competition for the possession and distribution of resources, which has attracted extensive attention of the international community for its unique complexity. The particularity and complexity of the Macao East Timor Sea dispute are mainly reflected in two aspects: one is that the demarcation and resource disputes are intertwined with the political evolution process of East Timor, and the other is the obvious power gap between the two parties to the dispute. The dispute over Australia's East Timor Sea was settled through diplomatic negotiations. The negotiations lasted more than six years, and the process was tortuous and complicated. Finally, the two sides agreed to temporarily shelve the sovereignty dispute, jointly exploit the oil and gas resources in the disputed waters within the scope of the joint cooperation zone, and signed a treaty on relevant institutional arrangements. It provides a stable legal basis for the exploitation of oil and gas resources. This result is the result of compromise between the two sides, to a certain extent, the interests of both sides have been satisfied. However, it is not difficult to find that although Australia and East Timor are two powerful negotiating forces, and there is still a strong dependence on assistance to Australia for national development in East Timor, during the whole negotiation process, Australia, however, has always been a relatively passive party, and the final outcome is far from Australia's original goal. This article will make the thorough analysis to the Australia East Timor Sea dispute origin and origin. Taking East Timor's national independence and history of development as the axis of time, this paper explores the settlement of the Timorese dispute during the period of Portuguese East Timor, the period of illegal Indonesian occupation, the transitional administration of the United Nations and the four periods following the formal independence of East Timor, This paper sums up the ideas of the settlement of the dispute over the Sea of East Timor in Australia and the factors restricting the choice of negotiation behavior between the two sides, especially the reasonable explanation of why the two sides compromise in the negotiation.
