【摘要】： 邊界領(lǐng)土爭(zhēng)端是相互接壤的國(guó)家之間普遍存在的現(xiàn)象,也是最常見(jiàn)的影響國(guó)家之間關(guān)系的因素之一。由于各種原因,東南亞是世界上陸地邊界領(lǐng)土爭(zhēng)端最復(fù)雜的地區(qū)之一。本文比較全面地論述了二戰(zhàn)后東南亞國(guó)家之間陸地邊界爭(zhēng)端的概況、產(chǎn)生原因、解決方式及其影響。 文章第一章全面地分析了東南亞國(guó)家間的大部分陸地邊界爭(zhēng)端,主要有柬埔寨和泰國(guó)、柬埔寨和越南、柬埔寨和老撾、老撾和泰國(guó)、泰國(guó)和緬甸、泰國(guó)和馬來(lái)西亞、緬甸和老撾、馬來(lái)西亞和印度尼西亞、文萊和馬來(lái)西亞之間的陸地邊界領(lǐng)土爭(zhēng)端。其中清晰地論述了爭(zhēng)端方對(duì)哪些地方有爭(zhēng)議,爭(zhēng)端產(chǎn)生的原因,爭(zhēng)端及其導(dǎo)致沖突的解決進(jìn)程。 文章第二章分析了東南亞國(guó)家解決相互之間陸地邊界領(lǐng)土爭(zhēng)端的模式,主要有三種模式：政治談判解決模式、武裝對(duì)抗加政治談判的解決模式、通過(guò)國(guó)際法院裁決的解決模式,不同的解決模式取得了不同的效果。 文章第三章分析了東南亞國(guó)家間陸地邊界領(lǐng)土爭(zhēng)端對(duì)爭(zhēng)端國(guó)家間關(guān)系、地區(qū)和平以及對(duì)東盟發(fā)展的影響。其中,根據(jù)國(guó)家間關(guān)系惡化譜系闡述了陸地邊界領(lǐng)土爭(zhēng)端對(duì)柬泰、柬越、老泰、泰緬關(guān)系的影響。在東盟發(fā)展的影響方面,本文認(rèn)為成員國(guó)之間的陸地邊界領(lǐng)土爭(zhēng)端久拖不決甚至惡化,使國(guó)際社會(huì)對(duì)東盟倡導(dǎo)的化解爭(zhēng)端、解決沖突的能力產(chǎn)生了懷疑,從而損害了其國(guó)際聲望,不可避免地對(duì)東盟安全共同體建設(shè)進(jìn)程和東盟一體化進(jìn)程產(chǎn)生消極影響。
[Abstract]:Border territorial disputes are a common phenomenon among bordering countries and one of the most common factors affecting inter-state relations. For various reasons, Southeast Asia is one of the most complicated areas in the world in land border territorial disputes. This paper comprehensively discusses the general situation of land border disputes between Southeast Asian countries after World War II, the causes, solutions and their effects. In the first chapter, the author makes a comprehensive analysis of most of the land border disputes among Southeast Asian countries, mainly Cambodia and Thailand, Cambodia and Vietnam, Cambodia and Laos, Laos and Thailand, Thailand and Myanmar, Thailand and Malaysia. Land border territorial dispute between Myanmar and Laos, Malaysia and Indonesia, Brunei and Malaysia. It clearly discusses the dispute between the parties to the dispute, the cause of the dispute, the dispute and its conflict settlement process. The second chapter analyzes the modes of settlement of land border territorial disputes between Southeast Asian countries. There are three main models: political negotiation, armed confrontation and political negotiation, and settlement through the International Court of Justice. Different solutions have different effects. The third chapter analyzes the influence of land border territorial disputes among Southeast Asian countries on the relations, regional peace and the development of ASEAN. Among them, according to the pedigree of deterioration of inter-state relations, the influence of land border territorial disputes on the relations between Cambodia and Thailand, Cambodia and Vietnam, Lao Thailand, Thailand and Myanmar is expounded. In terms of the impact of ASEAN's development, this paper holds that the territorial disputes on land borders among member States have been prolonged or even worsened, which has cast doubt on the ability of the international community to resolve disputes and resolve conflicts advocated by ASEAN. Therefore, it damages its international reputation and inevitably has a negative impact on the process of ASEAN security community construction and ASEAN integration.
