【摘要】：隨著人類信息技術(shù)的迅猛發(fā)展，以數(shù)字信息為載體的互聯(lián)網(wǎng)技術(shù)給人們生活的各方面，都帶來了翻天覆地的變化，同時(shí)也將我們帶入了大數(shù)據(jù)時(shí)代。從傳感器到智能手機(jī)，從搜索引擎到視頻網(wǎng)站，從電子商務(wù)到社交軟件，每天都有海量的數(shù)據(jù)產(chǎn)生，并發(fā)生跨國流動(dòng)擴(kuò)散。一國擁有數(shù)據(jù)的規(guī)模、獲取數(shù)據(jù)的速度、以及分析海量數(shù)據(jù)的能力，便成為了衡量國家實(shí)力強(qiáng)弱的重要指標(biāo)。數(shù)據(jù)主權(quán)的概念由此應(yīng)運(yùn)而生，并逐漸被納入到國家的核心權(quán)力之中。 大數(shù)據(jù)時(shí)代的到來，也對(duì)中國的外交戰(zhàn)略產(chǎn)生了深刻的影響。中國外交戰(zhàn)略目標(biāo)開始瞄準(zhǔn)數(shù)據(jù)的主權(quán)歸屬問題，外交戰(zhàn)略資源開始囊括數(shù)據(jù)資源，外交戰(zhàn)略選擇也開始考慮數(shù)據(jù)主權(quán)這種方式和手段。中國的外交戰(zhàn)略和數(shù)據(jù)主權(quán)，相互之間聯(lián)系越發(fā)密切，影響越發(fā)深刻。 然而，現(xiàn)實(shí)中各國信息化水平存在差距，對(duì)數(shù)據(jù)的掌控能力也各有不同。大數(shù)據(jù)的到來，反而拉大了一些發(fā)展中國家與發(fā)達(dá)國家間的差距，，落后國家無法有力地捍衛(wèi)自身的數(shù)據(jù)主權(quán)，同時(shí)又產(chǎn)生了一些違反主權(quán)平等原則的數(shù)據(jù)霸權(quán)的現(xiàn)象。尤其是在美國“棱鏡門事件”爆出之后，數(shù)據(jù)傳輸?shù)暮戏ㄐ浴⒖缇硵?shù)據(jù)流動(dòng)的安全性以及云存儲(chǔ)數(shù)據(jù)的可靠性都使得數(shù)據(jù)主權(quán)的概念備受爭(zhēng)議與關(guān)注。面對(duì)現(xiàn)實(shí)中發(fā)展中國家的數(shù)據(jù)主權(quán)所遭遇的嚴(yán)峻挑戰(zhàn)，我們應(yīng)積極吸取發(fā)達(dá)國家捍衛(wèi)自身數(shù)據(jù)主權(quán)的技術(shù)以及法律經(jīng)驗(yàn)，結(jié)合本國的實(shí)際情況，迎接好數(shù)據(jù)主權(quán)所面臨的挑戰(zhàn)，早日實(shí)現(xiàn)中國外交戰(zhàn)略布局。
[Abstract]:With the rapid development of human information technology, the Internet technology with digital information as its carrier has brought about tremendous changes in all aspects of people's lives, and it has also brought us into the era of big data, from sensors to smart phones. From search engines to video sites, from e-commerce to social software, huge amounts of data are generated every day, and cross-border flows spread. The scale of data a country has, the speed at which it can be acquired, and its ability to analyze massive amounts of data. It has become an important index to measure the strength of a country, and the concept of data sovereignty has emerged as the times require, and has gradually been brought into the core power of the country. The arrival of big data's era has also had a profound impact on China's diplomatic strategy. China's diplomatic strategic objectives have begun to aim at the issue of sovereignty over data, and diplomatic strategic resources have begun to include data resources. China's diplomatic strategy and data sovereignty have become more and more closely related and deeply influenced. However, in reality, there are gaps in the level of information technology in various countries, and their ability to control the data is different. Big data's arrival has widened the gap between some developing and developed countries. Backward countries are unable to defend their own data sovereignty, and at the same time they have some phenomena of data hegemony that violate the principle of sovereign equality, especially after the "Prism Gate incident" broke out in the United States, the legitimacy of data transmission. The security of cross-border data flow and the reliability of cloud storage data make the concept of data sovereignty controversial and concerned. We should actively absorb the technology and legal experience of developed countries in defending their own data sovereignty, combine the actual situation of our country, meet the challenge of data sovereignty, and realize China's diplomatic strategic layout at an early date.
