【摘要】：我國(guó)作為人民民主專政的社會(huì)主義國(guó)家,一直以來都將我國(guó)特有的人民代表大會(huì)制度奉行為國(guó)家的根本政治制度。因而,人大的監(jiān)督作用作為其中的基本職權(quán)就顯得頗具研究?jī)r(jià)值。在該項(xiàng)制度的實(shí)際操作過程中,國(guó)家機(jī)關(guān)以及執(zhí)行機(jī)關(guān)通常在研究實(shí)施結(jié)果以及效力反饋之后便可針對(duì)于我國(guó)的人民代表大會(huì)制度是否完備、詳盡做出相應(yīng)的判定。非但如此,這也是接下來制度完善、計(jì)劃制定的一個(gè)重要參考條件。一直以來,我國(guó)在制度創(chuàng)立、完善上對(duì)于機(jī)制創(chuàng)新青睞有加,在各項(xiàng)政治制度層出不窮的今天,在推進(jìn)人民代表大會(huì)制度的同時(shí)對(duì)于人大監(jiān)督權(quán)的普及工作也發(fā)展到了一個(gè)更加深層次的領(lǐng)域之內(nèi)。改革開放以來,國(guó)家對(duì)于該項(xiàng)制度的重視程度與日俱增,所傾注的“心血”也越來越多,因此,在此種天時(shí)、地、人和的情境之下其發(fā)展也必將呈“兇猛”之勢(shì)。然而,客觀的來看,我國(guó)作為人權(quán)、民主的新生勢(shì)力,相對(duì)于有著豐厚經(jīng)驗(yàn)的西方發(fā)達(dá)國(guó)家定是勢(shì)單力薄的,因而,總結(jié)與借鑒必將是我國(guó)人大監(jiān)督制度長(zhǎng)足發(fā)展的必經(jīng)之路�；诖�,筆者在文章主體構(gòu)造時(shí)便首先以人大監(jiān)督的概況為基本點(diǎn)進(jìn)行切入,首先對(duì)于現(xiàn)狀進(jìn)行分析,在深度了解的同時(shí)找出所存在的問題,其次結(jié)合西方發(fā)達(dá)國(guó)家經(jīng)驗(yàn)的同時(shí)融入本國(guó)國(guó)情,從而制定出最優(yōu)的發(fā)展計(jì)劃與途徑。
[Abstract]:As a socialist country under the people's democratic dictatorship, China has always pursued the unique system of the people's Congress as the fundamental political system of the country. Therefore, the supervisory role of the NPC as one of the basic functions and powers appears to be of considerable research value. In the practical operation of the system, the state organs and the executive organs usually study the results of the implementation and the effectiveness of feedback before making a detailed decision on the completeness of the system of the people's congresses in our country. Not only so, this also is the next system consummation, the plan formulates an important reference condition. For a long time, our country has been in favor of institutional innovation in terms of institutional creation and perfection. Today, with the emergence of various political systems in endlessly, While promoting the people's Congress system, the popularization of the people's Congress supervisory power has also developed into a deeper field. Since the reform and opening up, the country has paid more and more attention to the system and devoted more and more effort. However, objectively speaking, China, as a new force of human rights and democracy, is bound to be weak in comparison with the western developed countries with rich experience. Therefore, summing up and drawing lessons will be the only way for the great development of the supervision system of the people's Congress of our country. Based on this, the author of the article in the construction of the main body will first take the general situation of the National people's Congress as the basic point to cut into, first of all, to analyze the current situation, while in-depth understanding to find out the existing problems. Secondly, combining the experience of western developed countries and integrating into their national conditions, we can work out the best development plan and approach.
