【摘要】：二戰(zhàn)后,經(jīng)濟和科技飛速發(fā)展、資源開發(fā)和利用的需求空前增長、國家主權管轄范圍之外區(qū)域的競爭日益激烈,而海底正是這一類區(qū)域中各國密切關注和競相提出權利主張的焦點。從1967年帕多提案提出、美國內部開始海底決策討論、完成海底問題決策第一次轉向,到“人類共同遺產(chǎn)原則”提出、美國發(fā)表“尼克松聲明”實現(xiàn)第二次決策轉向,再到聯(lián)合國第三次海洋法會議后期美國態(tài)度日益強硬、開始單方面立法、并于1982年拒絕批準《聯(lián)合國海洋法公約》導致第三次海底決策轉向,美國海底問題決策經(jīng)歷了一個反復和復雜的過程。分析1967-1982年間美國海底問題決策制定過程與變化原因,既有國際層面的海底機制變遷影響,又有國內層面的政府政治因素,前者可通過復合相互依賴中的國際組織模式得到解釋,后者可利用決策的政府政治模式進行分析。在此基礎上,總體來看美國海底問題外交決策制定并探尋其本質,會發(fā)現(xiàn)其既有美國重要議題外交決策在政府政治上的共性、又有其自身參與政府政治、以及作為國際公共物品問題參與國際決策政治的特點。
[Abstract]:After World War II, with the rapid development of economy and science and technology, the demand for the exploitation and utilization of resources has increased unprecedentedly, and the competition in areas beyond the jurisdiction of national sovereignty has become increasingly fierce. The seabed is the focus of close attention and competing claims in this area. From the Pardo proposal in 1967, the United States began to discuss the undersea decisions within the United States, completed the first turn of decision-making on seabed issues, to the "principle of Common Heritage of mankind," the United States issued the "Nixon Declaration" to realize the second decision-making turn. At the end of the third United Nations Conference on the Law of the Sea, the United States became increasingly assertive, began to legislate unilaterally and, in 1982, refused to ratify the United Nations Convention on the Law of the Sea, which led to the third benthic decision-making shift. Undersea decision making in the United States has gone through an iterative and complex process. This paper analyzes the decision-making process and the reasons for the changes in the decision-making of submarine issues in the United States during 1967-1982. It has not only the influence of the changes of submarine mechanisms at the international level, but also the political factors of government at the domestic level. The former can be explained by the model of international organizations in the process of compound interdependence. The latter can be analyzed by using the government political model of decision-making. On this basis, on the whole, if the United States makes and explores the nature of diplomatic decision-making on undersea issues, it will find that it has both the commonalities in government politics and its own participation in government politics on important issues of diplomatic decision-making in the United States. And as an international public goods participation in international decision-making politics characteristics.
