【摘要】：香港反腐敗歷程當(dāng)中戲劇性地頒布"局部特赦令",一般都?xì)w因于警務(wù)人員對(duì)廉政公署反腐敗執(zhí)法的反彈。但警、廉沖突只是直接原因和具體表象,局部特赦的根本原因在于對(duì)零容忍原則下強(qiáng)力反腐所激起的更深層次、更廣范圍的沖突。這種沖突不僅來自警察系統(tǒng)尤其是基層警務(wù)人員,還包含其他部門的基層公務(wù)員、工商界甚至普通市民,不僅涉及腐敗行為,更是直接挑戰(zhàn)傳統(tǒng)腐敗習(xí)俗。局部特赦實(shí)質(zhì)上是對(duì)政府與社會(huì)當(dāng)中既往各種小腐敗、普遍盛行的習(xí)慣性腐敗行為一體懲處的劃斷性了結(jié),而非對(duì)于嚴(yán)重腐敗罪行的妥協(xié)與退讓。
[Abstract]:The dramatic partial amnesty in Hong Kong's anti-corruption history is generally attributed to police officers' reaction to the ICAC's anti-corruption law enforcement. But the police, the incorruptible conflict is only the direct cause and the concrete appearance, the fundamental reason of partial amnesty lies in the deeper and wider conflict caused by the strong anti-corruption under the principle of zero tolerance. This kind of conflict not only comes from the police system, especially the basic police personnel, but also includes the grass-roots civil servants of other departments, the business circles and even the ordinary citizens, not only involves the corrupt behavior, but also directly challenges the traditional corrupt custom. In essence, partial amnesty is not compromise and concession to the serious corruption crime, but to the government and the society in fact to punish all kinds of small corruption in the past, the common prevailing habitual corruption behavior in a body of punishment, but not the compromise and the concession to the serious corruption crime.
