【摘要】：因網(wǎng)絡(luò)原因引發(fā)的未成年人犯罪案件數(shù)逐年上升,網(wǎng)絡(luò)已成為誘發(fā)未成年人犯罪的重要因素。為了更好地消除網(wǎng)絡(luò)給未成年人帶來(lái)的不良影響,預(yù)防和控制因網(wǎng)絡(luò)原因引發(fā)的未成人犯罪,本文從近五年四川省某市兩級(jí)檢察院審查起訴的未成年人涉網(wǎng)犯罪案件情況出發(fā),以網(wǎng)絡(luò)對(duì)未成年人犯罪的影響進(jìn)行詳細(xì)分析,尋找出未成年人犯罪中的網(wǎng)絡(luò)誘因,并據(jù)此提出相應(yīng)對(duì)策。本文通過(guò)各種方法收集了2011-2015年四川省某市兩級(jí)人民檢察院審查起訴的未成年人涉網(wǎng)犯罪數(shù)據(jù),對(duì)該數(shù)據(jù)進(jìn)行統(tǒng)計(jì)和分析,并在此基礎(chǔ)上提出預(yù)防和控制未成年人涉網(wǎng)犯罪的建議和對(duì)策,以期對(duì)預(yù)防未成年人涉網(wǎng)犯罪提供參考。本調(diào)查報(bào)告分為六個(gè)部分,約2.3萬(wàn)字。第一部分主要說(shuō)明本次調(diào)查目的及意義,隨著我國(guó)互聯(lián)網(wǎng)的發(fā)展,網(wǎng)民年齡呈低齡化趨勢(shì),未成年人在“黃暴”網(wǎng)絡(luò)游戲及不良信息影響下實(shí)施犯罪的數(shù)量逐年上升。第二部分介紹本次調(diào)查樣本選擇、調(diào)查的時(shí)間和地點(diǎn)、調(diào)查的具體方法,包括查詢報(bào)表系統(tǒng)、信息交流、個(gè)案調(diào)查法、問(wèn)卷調(diào)查法等。第三部分是對(duì)本次調(diào)查對(duì)象的闡述,明確未成年人涉網(wǎng)犯罪對(duì)象的范圍,以提出有針對(duì)性的策略。第四部分是對(duì)本次調(diào)查結(jié)果的闡述:某市未成年犯罪人數(shù)總體情況、未成年人涉網(wǎng)犯罪數(shù)量、未成年人涉網(wǎng)犯罪的類型情況、未成年人涉網(wǎng)犯罪人員受教育情況、留守未成年人涉網(wǎng)犯罪情況、未成年人涉網(wǎng)犯罪人員所從事的工作情況、未成年人涉網(wǎng)犯罪的團(tuán)伙人數(shù)情況、未成年人涉網(wǎng)犯罪與同他人共同犯罪情況、未成年人涉網(wǎng)犯罪的再犯罪情況。第五部分是針對(duì)調(diào)查數(shù)據(jù)的詳細(xì)分析,包括:未成年人涉網(wǎng)犯罪向低齡化發(fā)展;未成年人受教育的程度不高,學(xué)校未開(kāi)設(shè)法制教育課;留守兒童在未成年人涉網(wǎng)犯罪已占相當(dāng)比例;未成年人就業(yè)保障不夠;對(duì)未成年人到網(wǎng)吧上網(wǎng)缺乏有效監(jiān)管。第六部分在探析未成年人涉網(wǎng)犯罪的基礎(chǔ)上,提出預(yù)防和控制未成年人犯罪的建議和對(duì)策:家庭作為未成年人成長(zhǎng)的重要場(chǎng)所,故應(yīng)加強(qiáng)對(duì)未成年人家庭的引導(dǎo),改變家長(zhǎng)對(duì)未成年人的傳統(tǒng)教育理念;學(xué)校開(kāi)設(shè)因年齡而宜的法制教育課,編寫(xiě)不同年齡段所需的教材,將法制教育制度化,從小培養(yǎng)未成年人的法治素養(yǎng);社會(huì)各部門(mén)認(rèn)真履行對(duì)網(wǎng)吧的管理職責(zé),把對(duì)網(wǎng)吧的管理納入網(wǎng)格化管理,由政府投入建設(shè)綠色網(wǎng)吧;網(wǎng)絡(luò)上充斥的各種不良信息,對(duì)未成年人的身心發(fā)育和健康成長(zhǎng)危害大,因此應(yīng)建設(shè)適合未成年人的綠色網(wǎng)絡(luò);加強(qiáng)對(duì)未成年人自身的網(wǎng)絡(luò)道德教育,提高其明辨明非的能力;檢察機(jī)關(guān)通過(guò)對(duì)未成年涉網(wǎng)犯罪人員貫徹寬嚴(yán)相濟(jì)的刑事政策,未成年人案件專案專辦,對(duì)附條件不起訴人員進(jìn)行觀護(hù)幫教,以及為減少在校學(xué)生犯罪率,與學(xué)校共建“關(guān)心下一代工作室”。
[Abstract]:The number of juvenile delinquency cases caused by network has increased year by year, and the network has become an important factor inducing juvenile delinquency. In order to better eliminate the harmful effects of the network on minors and to prevent and control juvenile delinquency caused by network reasons, this paper starts from the examination and prosecution of juvenile cyber crimes cases by two procuratorates in Sichuan Province in the past five years. This paper analyzes the influence of network on juvenile delinquency in detail, finds out the network inducement in juvenile delinquency, and puts forward corresponding countermeasures accordingly. Through various methods, this paper collects and analyzes the data of minors involved in cybercrime examined and prosecuted by the people's Procuratorate at two levels in a certain city of Sichuan Province from 2011 to 2015. On the basis of this, the author puts forward some suggestions and countermeasures to prevent and control juvenile cyber crime, in order to provide reference for the prevention of minors involved in cyber crime. The report is divided into six parts, about 23000 words. The first part mainly explains the purpose and significance of this investigation. With the development of the Internet in China, the age of Internet users tends to be younger, and the number of minors committing crimes under the influence of "yellow storm" online games and bad information is increasing year by year. The second part introduces the sample selection, the time and place of the investigation, the specific methods of the investigation, including inquiry report system, information exchange, case investigation, questionnaire survey and so on. The third part is the object of this investigation, to clarify the scope of minors involved in cybercrime, in order to put forward targeted strategies. The fourth part is the description of the results of this investigation: the overall situation of the number of juvenile delinquents in a certain city, the number of minors involved in cybercrime, the types of crimes committed by minors, and the education of minors involved in cybercrime. The situation of minors staying behind in connection with cybercrime, the work done by minors involved in cybercrime, the number of groups of minors involved in cybercrime, the situation of minors involved in cybercrime and the situation of minors committing crimes in association with others, Re-offending of minors involved in cybercrime. The fifth part is the detailed analysis of the survey data, including: the development of juvenile delinquency to the younger age, the minor education degree is not high, the school does not set up legal education course; Children left behind have accounted for a considerable proportion of minors involved in cybercrime; minors employment security is not enough; minors to Internet cafes lack of effective supervision. In the sixth part, based on the analysis of juvenile delinquency, the author puts forward some suggestions and countermeasures to prevent and control juvenile delinquency: the family is an important place for minors to grow up, so we should strengthen the guidance to minors' families. Changing the parents' traditional educational concept of minors, setting up legal education courses suitable for age in schools, compiling teaching materials for different ages, institutionalizing legal education, and cultivating the legal literacy of minors from an early age; All departments of society conscientiously perform their management duties on Internet cafes, bring the management of Internet cafes into the grid management, and the government invests in the construction of green Internet cafes. All kinds of bad information on the network is harmful to the physical and mental development and healthy growth of minors. Therefore, we should build a green network suitable for minors; strengthen the network moral education of minors themselves, and improve their ability to distinguish between right and wrong; the procuratorial organs should carry out a criminal policy of combining leniency and severity with punishment for juvenile cyber criminals. Minors' cases are specially organized, nursing, helping and teaching the qualified non-prosecution personnel, and "caring for the next Generation Studio" with the school to reduce the crime rate of the students in the school.
