【摘要】：高新區(qū)管委會(huì)在高新區(qū)的初創(chuàng)、二次創(chuàng)業(yè)、擴(kuò)容和自主創(chuàng)新示范區(qū)建設(shè)階段享有不同職能,呈逐步膨脹之勢,并超出了"園區(qū)管理"的范圍而趨同于一級(jí)政府,這種職能膨脹不具備憲法上的正當(dāng)性依據(jù)。十三五規(guī)劃綱要提出政府職能從研發(fā)管理向創(chuàng)新服務(wù)轉(zhuǎn)變的要求,此種轉(zhuǎn)化既有法律依據(jù),也有現(xiàn)實(shí)基礎(chǔ)。為實(shí)現(xiàn)此種轉(zhuǎn)變,園區(qū)管委會(huì)在組織結(jié)構(gòu)上須與地方政府分離,可從派出機(jī)構(gòu)轉(zhuǎn)變?yōu)樽灾谓M織;在職能上需剝離管理職能,強(qiáng)化服務(wù)職能;在與地方政府的關(guān)系上實(shí)現(xiàn)從"領(lǐng)導(dǎo)"到"指導(dǎo)"的轉(zhuǎn)變,同時(shí)確保科技企業(yè)通過章程實(shí)現(xiàn)對(duì)園區(qū)管委會(huì)之控制與監(jiān)督,使之致力于為科技企業(yè)提供創(chuàng)新服務(wù)。
[Abstract]:The management committee of the high-tech zone has different functions in the construction stage of the new high-tech zone, the second pioneering, the expansion and the independent innovation demonstration zone, and it has gradually expanded, and has gone beyond the scope of "park management" and converged to one level of government. This expansion of functions does not have constitutional legitimacy. The outline of the 13th Five-Year Plan puts forward the requirements for the transformation of government functions from R & D management to innovative services, which has legal basis as well as realistic basis. In order to realize this kind of transformation, the management committee of the park should be separated from the local government in organizational structure, which can be changed from the local organization to the autonomous organization, and the management function should be stripped off and the service function should be strengthened. In the relationship with the local government, the transformation from "leadership" to "guidance" is realized, and at the same time, scientific and technological enterprises are guaranteed to control and supervise the management committee of the park through the articles of association, so as to make them devote themselves to providing innovative services for the scientific and technological enterprises.
