【摘要】：從現(xiàn)代國(guó)家治理的視域分析,在當(dāng)代中國(guó)的政治生態(tài)中,政黨協(xié)商還面臨多重法理困境:一是民主黨派作為現(xiàn)代國(guó)家治理的重要主體,難以實(shí)現(xiàn)"依法參政";二是民主黨派參與國(guó)家治理,難以"使黨的主張通過(guò)法定的程序成為國(guó)家意志";三是政黨協(xié)商作為民主黨派參與國(guó)家治理的主要形式和重要渠道,難以實(shí)現(xiàn)"依法協(xié)商"。中共十八屆四中全會(huì)提出的"推進(jìn)社會(huì)主義民主政治的法治化"的主張,將堅(jiān)持和完善中國(guó)共產(chǎn)黨領(lǐng)導(dǎo)的多黨合作和政治協(xié)商制度,推進(jìn)社會(huì)主義協(xié)商民主廣泛多層制度化發(fā)展納入重點(diǎn)立法的領(lǐng)域,是破解當(dāng)前政黨協(xié)商法理困境的根本出路。
[Abstract]:From the perspective of modern state governance, in the political ecology of contemporary China, party consultation also faces many legal dilemmas: first, democratic parties as an important subject of modern state governance, It is difficult to achieve "participation in politics according to law"; second, democratic parties participate in state governance, and it is difficult to "make the party's proposal become the will of the state through legal procedures"; and third, party consultation is regarded as the main form and important channel for democratic parties to participate in the governance of the country. It is difficult to achieve "consultation according to law". The proposal of "promoting the legalization of socialist democratic politics" put forward by the fourth Plenary session of the 18th CPC Central Committee will uphold and improve the system of multi-party cooperation and political consultation under the leadership of the Communist Party of China. It is the fundamental way to solve the current dilemma of party consultation legal theory to push forward the socialist consultative democracy and bring it into the field of key legislation.
