【摘要】：英國脫歐公投的程序和結果引起了人們對于全民公決這種直接民主形式的廣泛爭論。質疑全民公決的觀點認為:全民公決不能作出科學、審慎的決策,甚至認為全民公決根本上并不是民主;但肯定脫歐公投的觀點認為:全民公決從程序上體現(xiàn)了民主。從民意表達功能及其實現(xiàn)方面看,英國脫歐公投實際上體現(xiàn)了長期被忽視和被排斥的民意,也體現(xiàn)了全民公決的價值:一是提供了政治決策至關重要的正當性與合法性,二是集中表達和體現(xiàn)了以民主機制為核心的民意。當然,在具體運用全民公決的過程中,還需要增強審慎因素,對議會民主和全民公決兩種方式進行充分權衡,謹慎設定全民公決的有效性標準。
[Abstract]:The procedure and outcome of the Brexit referendum have sparked widespread debate about the direct democratic form of a referendum. The viewpoint of questioning the referendum is that the referendum cannot make scientific and prudent decisions, and even that the referendum is not fundamentally democratic; but the point of view affirming the referendum on Brexit holds that the referendum embodies democracy in procedure. From the point of view of the public opinion expression function and its realization, the Brexit referendum actually reflects the public opinion which has been neglected and rejected for a long time, and the value of the referendum: first, it provides the legitimacy and legitimacy of the political decision. The other is to express and embody the public opinion with democratic mechanism as the core. Of course, in the process of applying the referendum, it is necessary to strengthen the prudent factors, balance the two ways of parliamentary democracy and referendum, and carefully set the criterion of the validity of the referendum.
