【摘要】：當前,網(wǎng)絡(luò)交流平臺逐漸在大眾話語表達機制中扮演起越來越重要的角色。但是,由于網(wǎng)絡(luò)表達機制的不規(guī)范和網(wǎng)絡(luò)監(jiān)管還存在一些問題,人民在質(zhì)疑網(wǎng)絡(luò)言論自由正當性和合理性的同時,政府監(jiān)管網(wǎng)絡(luò)也在很多方面受到網(wǎng)民的抵制和反感。在這種形勢下,探討以保障民意充分表達為前提的網(wǎng)絡(luò)監(jiān)管問題就顯得尤為重要。我國網(wǎng)絡(luò)監(jiān)管在保障民意充分表達方面尚存在的問題包括:網(wǎng)絡(luò)監(jiān)管部門職權(quán)劃分不清、監(jiān)管的方式單一且粗糙、網(wǎng)絡(luò)監(jiān)管中的管制多而保障少、網(wǎng)絡(luò)行業(yè)自我監(jiān)督的能力低等。引起這些問題的原因是多方面的,網(wǎng)絡(luò)監(jiān)管部門對網(wǎng)絡(luò)民意充分表達的正統(tǒng)性和合理性認識較為模糊;網(wǎng)絡(luò)監(jiān)管法律與制度不完善;網(wǎng)絡(luò)的開放性、匿名性等自身的特征增加了網(wǎng)絡(luò)監(jiān)管中的不可控因素;交錯復(fù)雜的行業(yè)利益追求導致了監(jiān)管難以完全到位;網(wǎng)民對網(wǎng)絡(luò)監(jiān)管存在偏見,同時網(wǎng)民的文化程度參差不齊和政治素質(zhì)普遍偏低也增加了網(wǎng)絡(luò)監(jiān)管困難。通過分析我國的具體情況,在學習和借鑒國外網(wǎng)絡(luò)監(jiān)管經(jīng)驗的基礎(chǔ)上,從六個方面探討以保障民意充分表達為前提的強化網(wǎng)絡(luò)監(jiān)管的路徑選擇:一是轉(zhuǎn)變政府網(wǎng)絡(luò)監(jiān)管理念;二是完善網(wǎng)絡(luò)監(jiān)管法律和制度;三是理清網(wǎng)絡(luò)監(jiān)管部門的職責;四是要加大監(jiān)管部門與互聯(lián)網(wǎng)行業(yè)的合作,注重網(wǎng)絡(luò)行業(yè)自我管理能力建設(shè);五是政府部門要注重對網(wǎng)民的政治素質(zhì)的培養(yǎng);六是監(jiān)管部門重視對網(wǎng)絡(luò)監(jiān)管技術(shù)的研發(fā)。在鼓勵網(wǎng)民自由表達的同時,引導網(wǎng)民理性發(fā)言、網(wǎng)絡(luò)言論合法傳播和網(wǎng)絡(luò)言論表達系統(tǒng)的有序運轉(zhuǎn),從而最大限度地發(fā)揮網(wǎng)絡(luò)媒介的作用,保障網(wǎng)絡(luò)民意充分表達的權(quán)利。
[Abstract]:At present, the network communication platform gradually plays an increasingly important role in the public discourse expression mechanism. However, there are still some problems due to the non-standard network expression mechanism and network supervision. People are questioning the legitimacy and reasonableness of the freedom of speech on the Internet, at the same time, the government supervision of the network is also resisted and repelled by netizens in many aspects. In this situation. It is particularly important to discuss the issue of network supervision which is based on the premise of ensuring the full expression of public opinion. In our country, there are still some problems in ensuring the full expression of public opinion, including the unclear division of functions and powers of the network supervision department. The way of supervision is single and rough, the regulation of network supervision is more and less, the ability of self-supervision of network industry is low, and so on. The causes of these problems are various. The understanding of the orthodoxy and rationality of the network public opinion fully expressed by the network supervision department is rather vague; The law and system of network supervision are not perfect; The openness and anonymity of the network increase the uncontrollable factors in the network supervision. The complex pursuit of industry interests leads to the difficulty of supervision. Internet users have prejudice to network supervision, at the same time, the uneven educational level and low political quality of Internet users also increase the difficulties of network supervision. Through the analysis of the specific situation of our country. On the basis of studying and learning from the experience of foreign network supervision, this paper probes into the path choice of strengthening network supervision based on the premise of ensuring the full expression of public opinion from six aspects: first, changing the concept of government network supervision; Second, perfect the law and system of network supervision; The third is to clarify the responsibilities of the network supervision department; Fourth, it is necessary to strengthen the cooperation between the regulatory department and the Internet industry, and pay attention to the self-management capacity construction of the network industry; Fifth, government departments should pay attention to the cultivation of Internet users' political quality; Sixth, the regulatory authorities attach importance to the research and development of the network supervision technology. While encouraging the free expression of Internet users, guide the Internet users to speak rationally, the legitimate dissemination of online speech and the orderly operation of the network speech expression system. In order to maximize the role of network media, to protect the right to fully express network public opinion.
