【摘要】：現(xiàn)代建設(shè)工程項目是一項復(fù)雜的系統(tǒng)工程。在建設(shè)工程項目實施過程中,眾多項目參與方之間,存在不同的合同關(guān)系。合同管理從建設(shè)工程的策劃、施工到竣工等各個階段都不可缺少且任務(wù)各不相同,因此,合同確定了工程的成本、工期、質(zhì)量等總體目標(biāo),規(guī)定和明確了當(dāng)事各方的權(quán)利和義務(wù)。而在實際的工程管理過程當(dāng)中,合同違約、違法現(xiàn)象頻繁出現(xiàn),導(dǎo)致合同信用的缺失,使項目參與主體間信任受損,進而可能造成工程質(zhì)量不達標(biāo)、資金和資源浪費等問題。本文基于國內(nèi)外對合同管理主體和任務(wù)的研究基礎(chǔ),首先,結(jié)合信用和績效的相關(guān)理論方法,對建設(shè)工程合同信用和合同管理績效的內(nèi)涵進行了系統(tǒng)性分析與界定;其次,運用系統(tǒng)論方法對合同全壽命周期的主要任務(wù)、目標(biāo)和特點進行了分析和歸納總結(jié),從合同策劃、合同簽訂、合同履行與合同終止四個階段全面和系統(tǒng)的分析了影響合同信用和合同管理績效的變量和指標(biāo),初步建立了二者的指標(biāo)體系;再次,通過問卷調(diào)研和相關(guān)統(tǒng)計分析工具對初選指標(biāo)體系進行篩選,進而得到影響變量的關(guān)鍵指標(biāo),并結(jié)合合同信用對合同管理績效的影響關(guān)系分析,從而構(gòu)建了變量之間的指標(biāo)體系和假設(shè)模型;最后基于結(jié)構(gòu)方程模型理論對假設(shè)模型進行擬合和修正,得到較為優(yōu)化和準(zhǔn)確的模型。通過對模型的分析研究,可以在一定程度上得到建設(shè)工程項目中合同信用與合同管理績效的影響關(guān)系和存在的影響因子,最終使工程參與方之間實現(xiàn)更有益的合作和共贏關(guān)系,對項目參與方提高自身合同管理的信用水平和管理績效水平,具有一定的理論意義和參考價值。
[Abstract]:Modern construction project is a complex system engineering. In the process of construction project implementation, there are different contractual relationships among many project participants. The contract management is indispensable from the planning of the construction project to the completion of the project, and the tasks are different. Therefore, the contract determines the overall objectives of the project, such as cost, time limit, quality, etc. The rights and obligations of the parties are defined and clarified. In the actual project management process, the contract breach of contract, illegal phenomenon frequently appears, resulting in the lack of contract credit, the project participants trust damage, which may lead to the project quality standards, capital and resource waste and other problems. Based on the domestic and foreign research on the subject and task of contract management, firstly, combining the related theories and methods of credit and performance, this paper systematically analyzes and defines the connotation of contract credit and contract management performance of construction project; secondly, This paper analyzes and summarizes the main tasks, objectives and characteristics of the whole life cycle of the contract by using the method of system theory, from the aspects of contract planning, contract signing, The four stages of contract performance and contract termination are comprehensively and systematically analyzed the variables and indicators that affect contract credit and contract management performance. Through the questionnaire survey and related statistical analysis tools to select the primary index system, and then get the key indicators of the impact variables, and combined with the contract credit impact on contract management performance analysis. Then the index system and the hypothesis model between variables are constructed, and the optimal and accurate model is obtained by fitting and modifying the hypothesis model based on the structural equation model theory. Through the analysis and study of the model, the relationship between contract credit and contract management performance and the existing influence factors can be obtained to a certain extent, and finally the beneficial cooperation and win-win relationship between the project participants can be realized. It has certain theoretical significance and reference value for the project participants to improve their own contract management credit level and management performance level.
