【摘要】：體外胚胎作為現(xiàn)代醫(yī)療科學(xué)技術(shù)發(fā)展的產(chǎn)物,在改變?nèi)祟惿丑w系的同時(shí),引發(fā)了一系列亟待解決的相關(guān)法律問題。通過對(duì)目前國(guó)內(nèi)相關(guān)學(xué)者所提出的"主體說""客體說"和"中介說"等學(xué)說的批判性思考,揭示其在理論層面的局限性,從而得以否定以上三種學(xué)說的合理性。而后從倫理學(xué)、法理以及比較法等角度對(duì)該問題進(jìn)行系統(tǒng)性的論述,揭示體外胚胎的法律地位,即人格利益屬性。在該定性的基礎(chǔ)之上,借助于有關(guān)學(xué)者提出的基因權(quán)理論,最終將體外胚胎界定為基因遺傳權(quán)的客體。因此,有必要對(duì)江蘇無錫冷凍胚胎案的裁判結(jié)果予以重新審視。同時(shí),建議在立法層面建立起體外胚胎基因遺傳權(quán)的法律保護(hù)體系,完善侵害基因遺傳權(quán)的救濟(jì)措施,以實(shí)現(xiàn)對(duì)體外胚胎基因遺傳權(quán)的法律保護(hù)。
[Abstract]:As a result of the development of modern medical science and technology, in vitro embryos change the human reproductive system and cause a series of related legal problems to be solved.Through critical thinking on the theories of "subject theory" "object theory" and "intermediary theory" put forward by relevant domestic scholars at present, this paper reveals their limitations on the theoretical level and thus negates the rationality of the above three theories.Then it systematically discusses this issue from the angles of ethics, jurisprudence and comparative law, and reveals the legal status of in vitro embryos, that is, the attribute of personality interests.On the basis of the qualitative analysis, the in vitro embryo is defined as the object of genetic right with the help of the genetic weight theory put forward by some scholars.Therefore, it is necessary to review the results of the frozen embryo case in Wuxi, Jiangsu Province.At the same time, it is suggested that the legal protection system of genetic rights of in vitro embryos should be established on the legislative level, and the remedy measures for infringement of genetic rights of in vitro embryos should be perfected in order to realize the legal protection of genetic rights of in vitro embryos.
