【摘要】：基因編輯技術(shù)的誕生使得基因定位、精準(zhǔn)修改成為現(xiàn)實(shí),在農(nóng)業(yè)生產(chǎn)、環(huán)境保護(hù)等領(lǐng)域有著廣泛的應(yīng)用,同時(shí)也帶來(lái)了很多不確定的風(fēng)險(xiǎn)。但當(dāng)前的基因法律規(guī)制不能適應(yīng)基因編輯技術(shù)的發(fā)展。基于此,本文就基因編輯技術(shù)的風(fēng)險(xiǎn)和利益訴求,分析了歐美基因編輯技術(shù)的法律規(guī)制、監(jiān)管方式及相關(guān)經(jīng)驗(yàn),論述了中國(guó)基因編輯技術(shù)應(yīng)用風(fēng)險(xiǎn)治理的法律路徑。
[Abstract]:The birth of gene editing technology has made gene location and precise modification a reality, and has been widely used in agricultural production, environmental protection and other fields. At the same time, it also brings a lot of uncertain risks. However, the current regulation of gene law can not adapt to the development of gene editing technology. This paper analyzes the legal regulation, supervision mode and relevant experience of gene editing technology in Europe and America, and discusses the legal path of risk management in the application of gene editing technology in China.
