【摘要】：從農(nóng)業(yè)文明到工業(yè)文明再到生態(tài)文明,是人類歷史的一大進步,它表明人與自然和諧共處的可持續(xù)發(fā)展趨勢,意味著人類的價值觀、消費觀、消費模式等都將發(fā)生重大變革。本文試圖通過追尋和把握這一社會發(fā)展趨勢,把生態(tài)文明理念與消費者義務(wù)結(jié)合起來進行研究,解讀消費者義務(wù)的新內(nèi)涵和獨有特征,并論證了消費者義務(wù)法律化的應(yīng)然與實然。在此基礎(chǔ)之上,提取國外消費者義務(wù)的立法經(jīng)驗,分別從消費者義務(wù)入憲法、入《消費者權(quán)益保護法》、入《環(huán)境保護法》三個方面來探討消費者義務(wù)法律制度的構(gòu)建,這正是本文的核心所在。然而任何法律都不可能孤立得存在,它必須有機得結(jié)合政治、經(jīng)濟等制度才能發(fā)揮最大效用,實現(xiàn)它的法律價值,因此本文的最后對消費者義務(wù)的實現(xiàn)路徑進行了大膽設(shè)想,從社會引導(dǎo)、政府調(diào)控、稅收監(jiān)管三個方面進行了淺顯的分析,以輔助生態(tài)文明理念下的消費者義務(wù)的實施。
[Abstract]:From agricultural civilization to industrial civilization to ecological civilization, it is a great progress in human history. It shows that the sustainable development trend of harmonious coexistence between man and nature means that great changes will take place in human values, consumption patterns and so on. This paper attempts to study the concept of ecological civilization and consumer obligation by pursuing and grasping this social development trend, interprets the new connotation and unique characteristics of consumer obligation, and demonstrates the necessity and reality of the legalization of consumer obligation. On this basis, the legislative experience of consumer obligations in foreign countries is extracted, and the construction of the legal system of consumer obligations is discussed from three aspects: consumer obligations into the Constitution, Consumer Rights and interests Protection Law and Environmental Protection Law, which is the core of this paper. However, no law can exist in isolation, it must be organically combined with political, economic and other systems in order to play the greatest role and realize its legal value. Therefore, at the end of this paper, the realization path of consumer obligations is boldly envisioned and analyzed from three aspects: social guidance, government regulation and tax supervision, in order to assist the implementation of consumer obligations under the concept of ecological civilization.
