【摘要】：我國農(nóng)村宅基地使用權(quán)制度是歷史發(fā)展的產(chǎn)物，自設(shè)立之初就承擔著社會保障功能，在大力發(fā)展重工業(yè)、農(nóng)村發(fā)展落后的政治、經(jīng)濟背景之下，將宅基地使用權(quán)人嚴格限定在本經(jīng)濟經(jīng)濟組織的確具有穩(wěn)定農(nóng)村的作用。但是，隨著市場經(jīng)濟體制的建立與不斷完善，城鄉(xiāng)之間人口、資源等要素的流動也越來越頻繁，這一制度安排已經(jīng)嚴重背離了市場經(jīng)濟本身的運行規(guī)律，使得農(nóng)村大量宅基地閑置和浪費，在整體上加劇了人地矛盾。同時，在“房地一體”主義的原則之下，限制農(nóng)村宅基地使用權(quán)轉(zhuǎn)讓， 也就變相的限制了農(nóng)民房屋的轉(zhuǎn)讓，損害了農(nóng)民財產(chǎn)權(quán)的實現(xiàn)。中共十八屆三中全全會審議通過的《決定》提出要保障農(nóng)民宅基地使用權(quán)用益物權(quán)，改善農(nóng)村宅基地使用權(quán)制度，選取試點，允許農(nóng)村宅基地使用權(quán)轉(zhuǎn)讓、抵押等，這為宅基地使用權(quán)轉(zhuǎn)讓制度改革指明了方向，是繼2007年《中華人民共和國物權(quán)法》將宅基地使用權(quán)作為用益物權(quán)的一種加以規(guī)定之后的又一次重要決定。但是，這種改革涉及到多方面利益關(guān)系的調(diào)整，需要我們在全面放開宅基地使用權(quán)轉(zhuǎn)讓，允許農(nóng)民進行自由轉(zhuǎn)讓同時，通過完善相關(guān)法律規(guī)范、落實變更登記、構(gòu)建實質(zhì)公平的利益分配方式等方面，，保障宅基地使用權(quán)轉(zhuǎn)讓制度改革的順暢、有序進行。
[Abstract]:The system of rural homestead use right in China is the product of historical development. It has assumed the function of social security from the beginning of its establishment. Under the political and economic background of vigorously developing heavy industry and backward rural development, the system of rural homestead use right is the product of historical development. Housing land use rights strictly limited in the economic organization does have the role of stabilizing the countryside. However, with the establishment and continuous improvement of the market economy system, the flow of population, resources and other elements between urban and rural areas has become more and more frequent. This institutional arrangement has seriously deviated from the operation law of the market economy itself. Make a large number of rural homestead idle and wasteful, on the whole exacerbated the contradiction between people and land. At the same time, under the principle of "integration of premises", restricting the transfer of the right to use the rural homestead, it also limits the transfer of the farmer's house in disguise, and damages the realization of the farmer's property right. The "decision" adopted by the third Plenary session of the 18th CPC Central Committee proposed to protect the usufruct of rural homestead use rights, improve the system of rural homestead use rights, select pilot projects, allow the transfer and mortgage of rural homestead use rights, etc. This has pointed out the direction for the reform of the system of the transfer of the right to use the homestead, and is another important decision after the 2007 Law of the people's Republic of China regarding the right to use the homestead as a usufruct right. However, this kind of reform involves the adjustment of various interests, which requires us to release the transfer of the right to use the homestead in an all-round way, to allow the peasants to transfer freely, and at the same time, to implement the change registration by perfecting the relevant laws and regulations. In order to ensure the smooth and orderly reform of the transfer system of homestead use right, it is necessary to construct a substantial and fair way of distribution of interests.
