【摘要】：本文是一篇翻譯實(shí)踐報(bào)告。翻譯的原文選自《中華人民共和國(guó)勞動(dòng)合同法》，屬于法律文本。這一法律文件規(guī)定了中華人民共和國(guó)境內(nèi)的勞動(dòng)合同的訂立、履行、變更、解除和終止，以及其他有關(guān)事項(xiàng)。隨著改革開放的不斷深入，中國(guó)與世界各國(guó)在政治、經(jīng)濟(jì)、文化和法律等領(lǐng)域的交往日益頻繁。在處理各種國(guó)際事務(wù)中，法律法規(guī)的作用顯得非常重要，因此越來(lái)越多的法律文本被翻譯成他國(guó)語(yǔ)言。好的譯文不僅能正確傳達(dá)出意思，還能為中國(guó)在國(guó)際交往中贏得有利地位。本翻譯實(shí)踐報(bào)告從奈達(dá)的功能對(duì)等理論出發(fā)，將作者的譯文與官方譯文進(jìn)行對(duì)比，從詞和句法層面總結(jié)出一些常用的法律文件漢譯英策略，如古體詞、正式詞匯、同義詞等的使用，以及句子中語(yǔ)態(tài)、結(jié)構(gòu)的改變等，以便對(duì)將來(lái)類似的法律文件漢譯英起到借鑒和指導(dǎo)作用。同時(shí)，作者也總結(jié)了自身在翻譯該法律文件過(guò)程中的不足和困難之處，，如法律專業(yè)知識(shí)欠缺，無(wú)法準(zhǔn)確應(yīng)用法律專業(yè)詞匯，以及對(duì)個(gè)別長(zhǎng)句理解和翻譯有困難等。
[Abstract]:This paper is a translation practice report. The original text of the translation is taken from the Labor contract Law of the people's Republic of China and belongs to the legal text. This legal document provides for the conclusion, performance, modification, dissolution and termination of labor contracts in the people's Republic of China, as well as other related matters. With the deepening of reform and opening up, China and other countries in the political, economic, cultural and legal exchanges are increasingly frequent. In international affairs, the role of laws and regulations is very important, so more and more legal texts have been translated into other languages. A good translation can not only convey the meaning correctly, but also win the favorable position for China in international communication. Based on Nida's functional equivalence theory, this translation report compares the author's translation with the official translation, and summarizes some commonly used translation strategies of legal documents, such as archaic words and formal words, from the lexical and syntactic levels. The use of synonyms, as well as the change of voice and structure in sentences, will serve as a reference and guide for the translation of similar legal documents into Chinese and English in the future. At the same time, the author also summarizes the shortcomings and difficulties in translating the legal documents, such as the lack of legal professional knowledge, the inability to use legal professional vocabulary accurately, and the difficulties in understanding and translating individual long sentences.
