東盟方式的運(yùn)作困境

【摘要】:冷戰(zhàn)后,經(jīng)濟(jì)危機(jī)、跨國移民等地區(qū)性問題開始質(zhì)疑“東盟方式”的合理性和有效性,要求修改不干涉內(nèi)政原則,強(qiáng)化東盟機(jī)制建設(shè),形成一套有效的跨國管理模式,更好地發(fā)揮其地區(qū)管理者的作用。那么,東盟會(huì)調(diào)整“東盟方式”以適應(yīng)不斷變化的國際和地區(qū)環(huán)境變化的需要嗎? 本文試圖從東盟有意識(shí)的加強(qiáng)自身組織建設(shè)過程中探尋“東盟方式”的困境。冷戰(zhàn)后,東盟組織經(jīng)歷了一系列重大調(diào)整。在組織結(jié)構(gòu)方面,完善決策機(jī)制滿足政治經(jīng)濟(jì)發(fā)展需要,吸收印支三國和緬甸實(shí)現(xiàn)大東盟夢(mèng)想。在組織目標(biāo)方面,借鑒歐洲共同體發(fā)展經(jīng)驗(yàn),成立自由貿(mào)易區(qū),加緊東盟共同體建設(shè)。然而,擴(kuò)大后的東盟成員國對(duì)國家主權(quán)的依然高度敏感,國家利益優(yōu)先于地區(qū)利益。東盟共同體建設(shè)并沒有深化成員國之間的政治經(jīng)濟(jì)聯(lián)系,推進(jìn)東盟制度化建設(shè),其目的是共同協(xié)商處理地區(qū)問題。因此,東盟組織的完善并沒改變東盟松散聯(lián)盟的性質(zhì),決定了“東盟方式”存在的必要。 然而,不容忽視的是:《東盟憲章》賦予了東盟法律人格,保障了東盟實(shí)體地位,確立了《東盟憲章》至高無上的地位以及普遍約束力。首腦會(huì)議的機(jī)制化以及東盟秘書處行政權(quán)力的擴(kuò)大強(qiáng)化了東盟的機(jī)制化建設(shè),突破了東盟對(duì)非正式安排的偏好,“加強(qiáng)互動(dòng)”概念的出臺(tái)和應(yīng)用軟化了不干涉內(nèi)政原則。他們或多或少都修正了傳統(tǒng)的“東盟方式”,而東盟互動(dòng)的持續(xù)加強(qiáng)必然導(dǎo)致“東盟方式”不斷變化。
[Abstract]:After the Cold War, the economic crisis, transnational migration and other regional issues began to question the rationality and effectiveness of the "ASEAN approach," and called for the revision of the principle of non-interference in internal affairs, the strengthening of the ASEAN mechanism, and the formation of an effective transnational management model.To play a better role as a regional manager.Will ASEAN adjust its approach to the changing international and regional environment?This paper tries to explore the predicament of ASEAN way from the process of consciously strengthening its own organization construction.After the cold war, ASEAN organization experienced a series of major adjustments.In terms of organizational structure, perfect the decision-making mechanism to meet the needs of political and economic development, absorb the Indochina three countries and Myanmar to realize the dream of Greater ASEAN.In terms of organizational objectives, draw lessons from the development experience of the European Community, set up a Free Trade area, and step up the construction of ASEAN Community.However, the expanded ASEAN members remain highly sensitive to national sovereignty and national interests take precedence over regional interests.The construction of ASEAN Community does not deepen the political and economic ties among member countries and promote the institutionalization of ASEAN. Its purpose is to deal with regional problems through joint negotiation.Therefore, the perfection of ASEAN does not change the nature of ASEAN loose alliance, which determines the necessity of ASEAN mode.However, it can not be ignored that the ASEAN Charter endows ASEAN with legal personality, guarantees ASEAN entity status, and establishes the supreme status and universal binding force of ASEAN Charter.The institutionalization of the summit and the expansion of the administrative power of the ASEAN Secretariat strengthen the institutional construction of ASEAN, break through ASEAN's preference for informal arrangements, and soften the principle of non-interference in internal affairs with the introduction and application of the concept of "enhanced interaction".They have more or less revised the traditional ASEAN mode, and the continuous strengthening of ASEAN interaction will inevitably lead to the constant change of ASEAN mode.
