【摘要】：高校管理機(jī)制是高校教學(xué)及學(xué)生管理工作中的重要組成部分,主要包括學(xué)生的學(xué)籍管理、學(xué)位管理、處分管理、日常管理等幾個(gè)方面,新的《普通高等學(xué)校學(xué)生管理規(guī)定》(簡(jiǎn)稱《管理規(guī)定》)于2005年9月1日由教育部頒布實(shí)施,新的規(guī)定頒布實(shí)施后,鞏固了近幾年來教育教學(xué)改革的成功經(jīng)驗(yàn),對(duì)拓展高校自律,進(jìn)一步明確學(xué)生的權(quán)利和義務(wù),規(guī)范高校管理發(fā)揮了重要指導(dǎo)作用。但高校在具體實(shí)施該《管理規(guī)定》中,仍存在一些問題,如重視對(duì)學(xué)生的管理和監(jiān)督職能,卻忽視對(duì)學(xué)生的權(quán)利保護(hù),法律意識(shí)仍然淡薄。高校更應(yīng)積極探索新的學(xué)生管理模式,積極穩(wěn)妥地推進(jìn)人才培養(yǎng)目標(biāo)的實(shí)現(xiàn)。隨著社會(huì)政治經(jīng)濟(jì)的不斷發(fā)展,學(xué)生法制意識(shí)的不斷增強(qiáng),新的問題會(huì)出現(xiàn),并在一段時(shí)間內(nèi)還將繼續(xù)存在。因此,高校管理應(yīng)樹立以生為本的管理理念,創(chuàng)新學(xué)生管理機(jī)制,實(shí)行依法治校,保護(hù)學(xué)生的合法權(quán)益。本文通過對(duì)我國(guó)現(xiàn)階段高校管理機(jī)制的闡釋,分析目前高校管理制度中學(xué)生權(quán)益保障存在的問題,結(jié)合國(guó)內(nèi)高校管理制度改革實(shí)踐,從高校自主管理權(quán)與學(xué)生受教育權(quán)的沖突、學(xué)生權(quán)益保障、育人為本與依法治校的角度探討建立健全高校管理制度的手段和方法,提出推進(jìn)我國(guó)高校管理制度建設(shè)的新構(gòu)想和新思路,以期對(duì)我國(guó)高校學(xué)生管理制度的完善提供借鑒。
[Abstract]:The management mechanism of colleges and universities is an important part of the teaching and student management in colleges and universities. It mainly includes student status management, degree management, disciplinary management, daily management and so on. The new "regulations on the Management of students in Colleges and Universities" (referred to as "regulations on Management") was promulgated by the Ministry of Education in September 1st 2005 and implemented after the promulgation of the new regulations. It has consolidated the successful experience of education and teaching reform in recent years, and has further clarified the rights and obligations of students in order to expand the self-discipline of colleges and universities. Standardizing the management of colleges and universities has played an important guiding role, but there are still some problems in the concrete implementation of the regulations, such as attaching importance to the management and supervision functions of students, but neglecting the protection of the rights of students. The legal consciousness is still weak. Colleges and universities should actively explore the new student management model, actively and steadily promote the realization of the goal of talent training. With the continuous development of social politics and economy, students' legal awareness is constantly strengthened. New problems will appear, and will continue to exist for a period of time. Therefore, college management should set up student-oriented management concept, innovate student management mechanism, and implement the rule of law. This paper analyzes the problems existing in the protection of the rights and interests of students in the present management system of colleges and universities in China, and combines the reform practice of the management system of colleges and universities in China with the analysis of the problems existing in the protection of the rights and interests of students. This paper probes into the means and methods of establishing and perfecting the management system of colleges and universities from the angle of the conflict between the right of independent management and the right of students to receive education, the protection of students' rights and interests, the education of people and the administration of schools according to law. This paper puts forward a new idea and new ideas to promote the construction of university management system in our country, in order to provide reference for the improvement of the management system of college students in our country.
