【摘要】：民國時期在慈善史的研究中是一個特殊歷史階段。夏明方指出：這一時期的慈善救濟(jì)事業(yè)研究“還是一片剛剛開辟有待于深耕擴(kuò)墾的荒地”。綜觀史學(xué)界對整個慈善史的研究,學(xué)者們對民國時期慈善事業(yè)發(fā)展的研究遠(yuǎn)遠(yuǎn)落后于對明代、清代的慈善事業(yè)研究。在區(qū)域慈善事業(yè)的研究中,還存在著很多方面的欠缺,學(xué)者對慈善法制法規(guī)的研究更是鮮有涉及。目前慈善史學(xué)界對青島慈善事業(yè)的研究集中于對青島慈善史發(fā)展概況、慈善組織團(tuán)體以及其社會影響等基本問題方面,尚有很大的研究發(fā)展空間。本文試圖對1922-1937年期問青島慈善法制的社會政治經(jīng)濟(jì)背景、慈善法規(guī)的內(nèi)容、特點(diǎn)、評價及對當(dāng)代慈善法制建設(shè)的啟示做一個系統(tǒng)的研究。除前言和結(jié)語之外,本文共分為四個部分：第一部分,本章圍繞民國時期在北洋政府和南京國民政府統(tǒng)治下的青島慈善事業(yè)發(fā)展的社會背景進(jìn)行論述。首先敘述了青島自開埠以來歷經(jīng)德日占領(lǐng)時期直至國民政府收回后,慈善事業(yè)發(fā)展的社會政治經(jīng)濟(jì)背景。然后對這一時期青島慈善事業(yè)發(fā)展的概況進(jìn)行了論述,從官辦和民間兩個角度,對青島的慈善事業(yè)中具有代表性的慈善組織和機(jī)構(gòu)的設(shè)置、宗旨及作用等方面展開論述。第二部分,本章主要以民國時期青島的慈善法律法規(guī)為對象,對青島慈善法制中的主要內(nèi)容展開論述。具體各節(jié)分別從慈善組織法規(guī)、慈善監(jiān)管法規(guī)、慈善稅收優(yōu)惠法規(guī)及慈善捐贈褒獎法規(guī)四個方面,選取其中具有代表性的中央和青島慈善法規(guī)盡心整理和分析,以期對這一時期青島慈善法制的內(nèi)容有一個概況性的了解。第三部分,本章將關(guān)注點(diǎn)集中在民國時期青島慈善法制的特點(diǎn)方面。民國時期是青島慈善事業(yè)發(fā)展的黃金時期,在慈善事業(yè)的快速發(fā)展中,其慈善法制逐漸建立發(fā)展起來,本章通過對上一章中慈善法制中的主要法規(guī)的制定、內(nèi)容及實(shí)施的分析,對青島慈善法制的特點(diǎn)進(jìn)行初步的探討和分析。本章主要選取了慈善法制的內(nèi)容、理念及功能三個方面對其特點(diǎn)進(jìn)行了分析和概括。第四部分,本章主要對民國時期青島慈善法制進(jìn)行了簡單的評價,并論述了其對當(dāng)代慈善立法的啟示。民國時期青島慈善事業(yè)得到迅速發(fā)展并開始走向興盛,其中慈善法律法規(guī)的制定和頒行對其發(fā)展產(chǎn)生重大影響,這種影響對當(dāng)今我國慈善事業(yè)的發(fā)展也有著一定的啟示。本章主要從這一時期青島慈善法制的對慈善事業(yè)本身的意義、在制定和實(shí)施中存在的局限以及對當(dāng)今慈善事業(yè)發(fā)展的啟示三個方面展開論述。總之,本文在廣泛搜集已有資料的前提下,以區(qū)域的視角,宏觀掌控,微觀著手,以1922年至1937年北洋政府及南京國民政府統(tǒng)治下的青島為中心,運(yùn)用歷史學(xué)、社會學(xué)和法學(xué)等多門學(xué)科的理論和方法,對青島社會慈善事業(yè)的發(fā)展?fàn)顩r,慈善法律法規(guī)的主要內(nèi)容、特點(diǎn)及對其的評價和當(dāng)代慈善法制建設(shè)的啟示等方面進(jìn)行系統(tǒng)的考察和探究。
[Abstract]:The period of the Republic of China is a special historical stage in the history of the study of the charity. The summer of Frances pointed out: "this period of charity relief or a deep expansion has just opened up to be reclaimed wasteland. In the study of the history of philanthropy in academic circles, scholars of the development of philanthropy is the period of the Republic of China behind of the Ming Dynasty, the Qing Dynasty on the charity. In the study area of charity, there are still many shortcomings, scholars of the legal regulations of charity is rarely involved. The historians of Qingdao charity charity research focused on the development of Qingdao charity history, the basic problem of charitable organizations group and its social influence, there is still a lot of room for development. This paper attempts to 1922-1937 year ask Qingdao charity legal system of the political and economic background, the charity regulations of the content, characteristics, evaluation The price and the enlightenment to the contemporary charitable legal system construction and make a systematic study. In addition to the preface and conclusion, this paper is divided into four parts: the first part, this chapter focuses on the period of the Republic of China in the Beiyang government and the national government in Nanjing under the social background of the development of charity in Qingdao were discussed. First described from Qingdao since its inception after the German occupation period until the national government to recover after the development of philanthropy social political and economic background. Then the situation of this period of Qingdao charity development are discussed, from two angles of government and private charitable organizations, the representative of Qingdao charities and institutions, is discussed on purpose and function. The second part, this chapter mainly to charity laws and regulations during the period of the Republic of Qingdao as object, discusses the main contents of the legal system of charity in Qingdao. In part, this chapter focuses on the period of the Republic of Qingdao charity legal system for a simple evaluation, and discusses its enlightenment to contemporary charity legislation. During the period of the Republic of Qingdao charity has been developing rapidly and began to flourish, the formulation and enactment of laws and regulations of the charity exerted a great influence on its development, the influence on the development of our charity the business also has a certain enlightenment. This chapter mainly from this period of Qingdao charity legal system of charity itself, there are three aspects in the formulation and implementation of the limitations and Enlightenment to the development of charity. In short, this paper based on widely collected data, by region from the perspective of macro control, micro start, from 1922 to 1937, the Beiyang government and Nanjing national government under the rule of Qingdao as the center, the use of history, sociology and law science Based on the theory and method, this paper systematically investigates and explores the development of Qingdao social charity, the main contents, characteristics and evaluation of charitable laws and regulations, as well as the enlightenment to contemporary charity legislation.
