房屋維修資金管理制度的研究

【摘要】:維修資金是專項(xiàng)用于房屋保修期滿,共用部位和共用設(shè)施設(shè)備的維修和更新、改造,是保障房屋正常使用和保值增值的基礎(chǔ)。維修資金制度是保持房屋完好率,提高和延長(zhǎng)房屋的使用壽命,提高房屋使用安全系數(shù)的重要保障。因此,維修資金管理制度的設(shè)計(jì)、完善和實(shí)施,直接關(guān)系到城市居民的切身利益和社會(huì)和諧。我國(guó)房屋維修資金管理制度的建立已有十幾年歷史,在居民的現(xiàn)實(shí)生活中也起到非常重要的作用。但由于各種主客觀原因,目前的制度建設(shè)還存在著許多瑕疵,以至于維修資金的歸集和使用還不盡如人意。本文旨在進(jìn)一步剖析現(xiàn)行的維修資金管理制度,并對(duì)修正該制度提出建設(shè)性意見。 房屋維修資金是為了解決房屋的物質(zhì)缺損,為此本文從房屋物質(zhì)形態(tài)變化規(guī)律入手,,研究房屋物質(zhì)實(shí)體損壞的恢復(fù)和房屋維修的需求。然后再分析房屋維修資金制度的演變過程,把握維修資金制度建設(shè)對(duì)社會(huì)發(fā)展的推動(dòng)作用,同時(shí)也能理解這些法規(guī)存在某些問題的原因。 通過對(duì)國(guó)外維修資金管理制度的比較和對(duì)現(xiàn)行維修資金管理制度的分析,找到了我國(guó)維修資金制度中存在著維修資金續(xù)交、申請(qǐng)使用手續(xù)、結(jié)構(gòu)維修以及維修責(zé)任主體難尋等諸多問題。同時(shí)也提出了對(duì)某些法律法規(guī)的修改和對(duì)《物權(quán)法》司法解釋的補(bǔ)充建議。本文還對(duì)公共政策績(jī)效的評(píng)價(jià)進(jìn)行了大膽的嘗試,并試析了某個(gè)城市的維修資金管理制度的績(jī)效。
[Abstract]:The maintenance fund is specially used for the maintenance and renewal of the common parts and facilities, which is the basis for the normal use and maintenance and increment of the house. The maintenance fund system is an important guarantee to maintain the perfect rate of housing, to improve and prolong the service life of houses and to improve the safety factor of housing use. Therefore, the design, perfection and implementation of maintenance fund management system are directly related to the vital interests of urban residents and social harmony. The establishment of housing maintenance fund management system in China has a history of more than ten years and plays a very important role in the real life of residents. However, due to various subjective and objective reasons, there are still many defects in the current system construction, so that the collection and use of maintenance funds is not satisfactory. The purpose of this paper is to further analyze the current maintenance fund management system and put forward some constructive suggestions for its amendment. The purpose of building maintenance fund is to solve the material defect of building. This paper starts with the change law of building material form and studies the restoration of material entity damage and the requirement of building maintenance. Then it analyzes the evolvement process of housing maintenance fund system, grasps the promotion effect of maintenance fund system construction on social development, and can also understand the reasons of some problems in these laws and regulations. Through the comparison of the maintenance fund management system abroad and the analysis of the current maintenance fund management system, it is found that the maintenance fund continues to be handed over in the maintenance fund system of our country, and the procedures for applying for the use of the maintenance fund are found. Many problems such as structural maintenance and maintenance responsibility are difficult to find. At the same time, it also puts forward some amendments to some laws and regulations and supplementary suggestions to the judicial interpretation of Real right Law. This paper also makes a bold attempt to evaluate the performance of public policy and analyzes the performance of maintenance fund management system in a certain city.
