【摘要】：將農(nóng)村土地承包經(jīng)營權(quán)設(shè)立信托,在全國多個(gè)地方已經(jīng)實(shí)施并取得了良好的實(shí)際成效。在農(nóng)村土地承包經(jīng)營權(quán)信托關(guān)系的三方當(dāng)事人中,農(nóng)村土地承包經(jīng)營權(quán)信托受托人處于核心地位,對(duì)農(nóng)村土地承包經(jīng)營權(quán)的管理、使用、等權(quán)利均由受托人行使；農(nóng)村土地承包經(jīng)營權(quán)信托關(guān)系的存續(xù)、信托事務(wù)的處理、及信托目的的實(shí)現(xiàn),都依賴于農(nóng)村土地承包經(jīng)營信托受托人的忠誠和能力。所以說,農(nóng)村土地承包經(jīng)營信托受托人是農(nóng)村土地承包經(jīng)營信托關(guān)系中最重要的當(dāng)事人。我國農(nóng)村土地承包經(jīng)營權(quán)信托近20年的發(fā)展歷程表明,農(nóng)村土地承包經(jīng)營權(quán)受托人權(quán)利義務(wù)的不完善,嚴(yán)重影響我國農(nóng)村土地承包經(jīng)營權(quán)信托業(yè)的正常發(fā)展,因此,完善我國農(nóng)村土地承包經(jīng)營信托受托人制度具有重要的意義。 本文的核心是論述我國實(shí)行農(nóng)村土地承包經(jīng)營權(quán)受托人的界定、權(quán)利和義務(wù)。權(quán)利主要包括四個(gè)方面：農(nóng)村土地承包經(jīng)營權(quán)的管理權(quán)、獲得賠償權(quán)、補(bǔ)償權(quán)、辭任權(quán)等。農(nóng)村土地承包經(jīng)營權(quán)信托受托人的義務(wù)主要是從善良管理人義務(wù),忠實(shí)義務(wù),注意義務(wù),分別管理義務(wù)四個(gè)方面進(jìn)行闡述。最后主要從具體化農(nóng)村土地承包經(jīng)營權(quán)受托人的權(quán)利、完善農(nóng)村土地承包經(jīng)營權(quán)受托人的義務(wù)提一點(diǎn)建議。
[Abstract]:Setting up trust of rural land contract management right has been implemented in many places of the country and has achieved good practical results. Among the three parties involved in the trust relationship of the rural land contractual management right, the trustee of the rural land contractual management right trust is in the core position, and the management, use, and other rights of the rural land contractual management right are exercised by the trustee. The existence of the trust relationship, the handling of the trust affairs and the realization of the purpose of the trust all depend on the loyalty and ability of the trustees of the rural land contract management trust. Therefore, the trust trustee of rural land contract management is the most important party in the trust relationship of rural land contract management. The development of rural land contractual management right trust in China in the past 20 years shows that the imperfection of the rights and obligations of the trustee of rural land contractual management right seriously affects the normal development of the trust industry of rural land contractual management right. It is of great significance to perfect the trust trustee system of rural land contract management in China. The core of this paper is to discuss the definition, rights and obligations of the trustees of rural land contractual management in China. The right includes four aspects: the right to manage rural land contract, the right to obtain compensation, the right to resign. The fiduciary duty of rural land contract management right is mainly elaborated from four aspects: good manager duty, loyalty duty, attention duty and management obligation. Finally, some suggestions are put forward from concretizing the rights of the trustees of the rural land contractual management right and perfecting the duties of the rural land contractual management right trustees.
