重慶農(nóng)村土地承包經(jīng)營權(quán)抵押貸款的路徑優(yōu)化研究

【摘要】:缺乏有效抵押物使得農(nóng)村融資難,農(nóng)民獲取貸款難,農(nóng)村土地承包經(jīng)營權(quán)抵押貸款的出現(xiàn),使農(nóng)村土地經(jīng)營者取得中長期信貸資金成為現(xiàn)實,這也是農(nóng)業(yè)可持續(xù)發(fā)展的關(guān)鍵措施之一。本文采取理論分析、案例分析以及博弈分析相結(jié)合的研究方法,立足于國情和重慶實際,對農(nóng)村土地承包經(jīng)營權(quán)抵押貸款的主體行為選擇進(jìn)行研究,探索其發(fā)展的內(nèi)在動力。通過對重慶農(nóng)村土地承包經(jīng)營權(quán)抵押貸款實施的背景分析,總結(jié)國內(nèi)外研究現(xiàn)狀;以土地產(chǎn)權(quán)理論、土地信用理論及風(fēng)險理論、規(guī)模經(jīng)濟(jì)理論作為指導(dǎo),描述了重慶市農(nóng)村土地承包經(jīng)營權(quán)抵押貸款的現(xiàn)狀及存在的問題,主要表現(xiàn)在抵押權(quán)難實現(xiàn)、抵押物價值難確定、貸后管理難、貸款風(fēng)險難控制、法律不完善、金融機(jī)構(gòu)放貸積極性不高等方面。用博弈方法分析銀行和農(nóng)業(yè)經(jīng)營大戶的貸款選擇策略,找到促進(jìn)其發(fā)展的內(nèi)在動力。研究表明,只有當(dāng)土地承包經(jīng)營權(quán)可以變現(xiàn)才能成為一個可置信威脅,銀行選擇貸款給農(nóng)業(yè)經(jīng)營大戶,農(nóng)業(yè)經(jīng)營大戶也會選擇償還貸款,政府應(yīng)該最大限度的幫助農(nóng)業(yè)生產(chǎn)者降低生產(chǎn)風(fēng)險獲取收益償還貸款;農(nóng)業(yè)生產(chǎn)的特殊性使得農(nóng)業(yè)經(jīng)營大戶可能無法償還貸款,此時銀行將變現(xiàn)土地承包經(jīng)營權(quán)以獲得補(bǔ)償,因此,土地承包經(jīng)營權(quán)能夠快速便捷的變現(xiàn)是促進(jìn)抵押貸款實施的有效路徑。針對存在問題和博弈策略,設(shè)計了重慶市農(nóng)村土地承包經(jīng)營權(quán)抵押貸款的優(yōu)化方案,,方案包括操作流程的優(yōu)化,政策優(yōu)化和風(fēng)險防范三個方面;操作流程的優(yōu)化,嚴(yán)格加入評估環(huán)節(jié),擔(dān)保公司參與,評估機(jī)構(gòu)和擔(dān)保公司通過登記,能形成有效信息交流。為保證土地承包經(jīng)營權(quán)抵押貸款操作順暢,還需要完善法律、建立土地流轉(zhuǎn)市場、引導(dǎo)資金流向等多方面的政策支持。
[Abstract]:The lack of effective mortgage makes it difficult to finance in rural areas, difficult for farmers to obtain loans, and the emergence of mortgage loans for contracted management of rural land makes it a reality for rural land operators to obtain medium- and long-term credit funds. This is also one of the key measures for sustainable agricultural development. This paper adopts the research methods of theoretical analysis, case analysis and game analysis, based on the situation of Chongqing and the reality of Chongqing, studies the subject behavior choice of the rural land contractual management right mortgage loan, and explores the internal motive force of its development. Based on the background analysis of the implementation of mortgage loan for rural land contractual management in Chongqing, this paper summarizes the current research situation at home and abroad, which is guided by land property right theory, land credit theory and risk theory, and scale economy theory. This paper describes the present situation and existing problems of mortgage loan for contracted land management right in rural areas of Chongqing, which are mainly manifested in the difficulty of realizing mortgage right, the difficulty of determining the value of mortgage, the difficulty of management after loan, the difficulty of controlling loan risk, and the imperfection of law. Financial institutions lending enthusiasm is not high, and so on. This paper analyzes the loan selection strategies of banks and large agricultural operators by means of game theory, and finds out the internal motive force to promote their development. Studies have shown that only when the land contractual management right can be realized can it become a credible threat. Banks choose to lend to large agricultural operators, and large agricultural operators will also choose to repay the loans. The government should help agricultural producers to reduce the risk of production to obtain income to repay loans; the particularity of agricultural production may make large agricultural operators unable to repay loans, and the banks will realize the land contractual management right to get compensation. Therefore, land contractual management right can be realized quickly and conveniently is an effective way to promote the implementation of mortgage loan. Aiming at the existing problems and game strategy, the optimization scheme of Chongqing rural land contracted management right mortgage loan is designed. The scheme includes three aspects: the optimization of operation flow, the optimization of policy and risk prevention, the optimization of operation process, and the optimization of operation process. Join the evaluation link strictly, the guarantee company participates, the appraisal organization and the guarantee company can form the effective information exchange through the registration. In order to guarantee the smooth operation of the mortgage loan of the land contract and management right, it is necessary to perfect the law, establish the land circulation market, guide the fund flow and other aspects of policy support.
