信貸消費(fèi)者權(quán)益保護(hù)法律問題研究

【摘要】:無論在歷史還是現(xiàn)實(shí)中,國(guó)外還是國(guó)內(nèi),信貸消費(fèi)對(duì)經(jīng)濟(jì)發(fā)展有著強(qiáng)勁的刺激作用和推動(dòng)作用。在現(xiàn)代社會(huì),信貸消費(fèi)已經(jīng)成為一種重要的消費(fèi)方式和拉動(dòng)經(jīng)濟(jì)增長(zhǎng)的力量;趯(duì)信貸消費(fèi)的規(guī)范和保護(hù),世界金融發(fā)達(dá)國(guó)家?guī)缀醵冀⒘讼鄳?yīng)的法規(guī)體系,尤其是2008年金融危機(jī)之后,各國(guó)相繼完善了金融立法,并牢固樹立了金融消費(fèi)者保護(hù)的理念。我國(guó)信貸消費(fèi)制度極不完善,相關(guān)概念、法律關(guān)系權(quán)利義務(wù)、消費(fèi)者權(quán)益內(nèi)容不明確,缺乏相應(yīng)保護(hù)措施和配套制度。本文基于我國(guó)學(xué)術(shù)研究和立法現(xiàn)狀,從信貸消費(fèi)者概念界定、信貸消費(fèi)者權(quán)利內(nèi)容和邏輯結(jié)構(gòu)、信貸糾紛解決機(jī)制三個(gè)基礎(chǔ)問題出發(fā),對(duì)信貸消費(fèi)者保護(hù)問題進(jìn)行研究。本文信貸消費(fèi)者界定為憑借個(gè)人信用向信貸機(jī)構(gòu)申請(qǐng)獲取貸款的個(gè)人或家庭,其貸款目的是滿足個(gè)人基本生活需要。在確定信貸消費(fèi)者概念的基礎(chǔ)上,闡述信貸消費(fèi)者權(quán)利內(nèi)容和其中的邏輯關(guān)系,即以知情權(quán)為基礎(chǔ)、以公平交易權(quán)為核心、以救濟(jì)權(quán)為保障、以隱私權(quán)為線索的權(quán)利體系,對(duì)各層次權(quán)利保護(hù)的國(guó)內(nèi)外立法實(shí)踐研究并提出針對(duì)我國(guó)制度建設(shè)的建議。針對(duì)信貸消費(fèi)者救濟(jì)權(quán)保障問題,文章第四部分就信貸糾紛解決方式進(jìn)行了專門研究,提出了以金融機(jī)構(gòu)內(nèi)部糾紛回應(yīng)機(jī)制和銀行業(yè)協(xié)會(huì)糾紛調(diào)解制度為內(nèi)容的自律性糾紛協(xié)商解決機(jī)制,以金融監(jiān)管機(jī)構(gòu)為核心主體的行政性裁決機(jī)制,以仲裁機(jī)制和公司法人裁決為形式的社會(huì)中介機(jī)構(gòu)裁決機(jī)制,以公益訴訟、代表人訴訟、小額速裁制度和特殊普通程序?yàn)閮?nèi)容的訴訟糾紛解決機(jī)制。
[Abstract]:Whether in history or reality, abroad or at home, credit consumption plays a strong role in stimulating and promoting economic development. Credit consumption has become an important consumption mode and a driving force for economic growth. Based on the regulation and protection of credit consumption, almost all the developed countries in the world have established corresponding laws and regulations, especially after the 2008 financial crisis. Various countries have perfected financial legislation one after another, and firmly established the concept of financial consumer protection. China's credit consumption system is very imperfect, related concepts, legal relations rights and obligations, consumer rights and interests content is not clear, Based on the current situation of academic research and legislation in China, this paper starts from three basic problems: the definition of credit consumer, the content and logical structure of credit consumer's right, and the mechanism of credit dispute resolution. This paper defines credit consumers as individuals or families who apply for loans from credit institutions on the basis of personal credit. The purpose of the loan is to meet the basic living needs of individuals. On the basis of defining the concept of credit consumers, this paper expounds the content of credit consumers' rights and their logical relations, that is, the right to know is the foundation, and the right to fair trade is the core. Taking the right of relief as the guarantee and the right system of privacy as the clue, this paper studies the domestic and foreign legislative practice of the protection of the rights at all levels and puts forward some suggestions for the construction of the system of our country, as well as the protection of the right of relief to the credit consumers. In the fourth part of the article, the author makes a special study on the ways of resolving credit disputes, and puts forward a self-disciplinary dispute settlement mechanism, which is based on the internal dispute response mechanism of financial institutions and the dispute mediation system of banking association. The administrative adjudication mechanism, which takes the financial supervision institution as the core subject, the social intermediary agency adjudication mechanism in the form of arbitration mechanism and the corporate legal person ruling mechanism, the public interest litigation and the representative lawsuit, The small amount quick adjudication system and the special ordinary procedure as the content litigation dispute settlement mechanism.
